| Show It was Only a Flash F W Becker the architect appeared before be-fore Commissioner Norrell yesterday to answer to the charge of embezzlement He was represented by Judge Hoge and the prosecuting witness a Mr Swan by S H Lewis A plea of not guilty was entered I The first witness called was Edward D Swan who testified In the early part of winter I negotiated with the defendant to make a double house for me There was on old adobe house standing on the site at the time Mr Becker was to use none of the old material and was to erect the building build-ing for 2000 That was the contract I asked him to make changes in some windows win-dows and he did so saying he would charge me just whatever it cost I do not know where the contract is now I left it with Becker and ho told me he had destroyed des-troyed it Several of the people who worked for Becker have not yet been paid In February Becker came to me and told me he wanted 5175 to pay Schoppe the tin ner and Lynn the lumber man I saw him afterwardsafter Mr Lynn had written me a note saying that he had a bill against Becker for SHJ I then asked him what he did with the money He said he had lost it that at some time he would tell me all about and that it would be all right I afterwards met him in his office and told him I thought he had obtained the money under false pretences and had appropriated appropri-ated it to his own use He made no reply but turned around and left me He was the contractor I have paid him about 1893 altogethersomething about that I received notices from Mr Lynn and Mr Schoppe that he was owing them I paid the defendant the 375 on the 7th of February Febru-ary It was after that I received the notice no-tice from him I paid the money to him before be-fore I got the notice from Mr Lynn Mr Lewis VVell that settles it The Commissioner you desire to go any further Mr Lewis 1 Mr LewisNo The Commissioner Well I think that under the circumstances I shall have to dismiss dis-miss the case There is nothing that I can see whereby the defendant can be held |
