Russias Plan Special t THE HKiiALDExaminer Dispatch WASHINGTON March 29 Mr Murat Hal stead of Ohio who was nominated Wednesday Wednes-day as minister to Germany was yesterday rejected by the Senate in executive session by a vote of 22 to 17 five Republicans together with the Democrats voting solidly against him The Republicans who opposed Mr Halstead are said to be Messrs Cullom and FarwelJ of Illinois Plumb and Ingalls of Kr is and Teller of Colorado The Senate spent nearly an hour discussing 11 Halsteads nomination before a vote was reached The debate was limited entirely to the Republican side none of the Democrats Demo-crats taking any action in the matter beyond be-yond recording their individual votes against Mr Halstead A GOOD DEAL OF GOSSIP about the senatorial action and its moving causes is flying about tonight I is said for instance that Senator Payne of Ohio asked his Democratic associates to stand with him in opposing 11 Halsteads confirmation con-firmation He made it a personal matter claiming that such action would be in the nature of a vindication and went so far it is reported as to threaten to resign and permit his place to be filled by a Republican in case they refused The opposition to 11 Halstead dates back to a period of two years and a half ago when an attempt was made on the part of the Republican members of the Ohio legislature to secure an investigation by the Senate of the manner in which Mr Payne had secured his election to the Senate The memorial was referred to THE COMMITTEE ON PRIVILEGES AND ELECTIONS ELEC-TIONS which consisted of Senators Hoar of Massachusetts Frye of Maine Teller of Colorado Evarts of New York Logan of Illinois Republicans and Saulsbury of Delaware Vance of North Carolina Pugh of Alabama and Bust of Louisiana Democrats The committee considered the matter several days The majority report which was by Messrs Teller Evarts and Logan as well as the four Democratic members of the committee decided that they had no jurisdiction in the case A minority report favoring the investigation was filed by Messrs Hoar and Frye Mr Halstead subsequently indulged in his paper the Cincinnati Commercial Gazette in certain strictures upon the members signing the majority report and especially the Republican Repub-lican members for their action in the matter mat-ter I has been hinted for several days that those publications would be used to sere I se-re his rejection when his nomination was i brought before the Senate Before r adjournment was a reached today Senator Sherman made a motion to reconsider recon-sider the vote for rejection which was agreed to At Thursdays session an effort made to Mr Halsteads confirmation was e secure firmation and several Republicans who declared de-clared their intention to vote yesterday were expected to give him their support Not so Friendly as That WASHINGTON March 3Vhen the Russian Rus-sian extradition treaty comes up in the Senate as it may today it is expected to encounter quite as bitter an opposition as the British extradition treaty The objectionable objec-tionable feature of the British treaty was the paragraph which permitted the extradition extra-dition of political offenders and which was generally known as the dynamite clause On a motion to strike out the clause but two gentlemen Messrs Edmunds and Morgan voted in the negative all the other members of the Senatorial body supporting it warmly The Russian treaty is thought to be in its way quite as objectionable as tho British treaty and for substantially the same reason viz the permission it gives for the extradition of political criminals crimi-nals THE LETTER AND SPIRIT OF THE TREATY Several of the Senators consider this clause as antagonistic to the principles prin-ciples of our republican institutions The paragraph having reference to politi teal crimes is as follows Murder and manslaughter comprising the willful or negligent killing of the sovereign or chief magistrate of the state or any member of his family as well as an attempt to commit com-mit or participating in the said crimes shall not be construed an offense of a polit lent character Senators Evans Eustis and George have c repeatedly stated their i objections to the treaty in its present form and it is understood under-stood that they as well as other gentlemen on both sides will oppose its ratification The objections which will be made to the foregoing clause are summarized in the following fol-lowing argument which has been presented to several Senators and which ha their support been engaged in revolutionary revo-lutionary projects in that empire I fugitives fugi-tives demanded under this treaty were t be tried according to the rules flaw f-law as for ordinary offenses there could be but little objection t such a provision but the difference proceedure andpunishment according to Russian law between ordinary ordi-nary cases of murder and manslaughter crimes including attempts and political incuding atempts against great the life of the Czar are very According to the principles recognized everywhere by international law and comity com-ity a demand for extradition should only be allowed where the legislation of the state which demands it conforms it to the principles adopted by civilized nations But in respect to political trials Russian jurisprudence juris-prudence does not conform to any principles princi-ples adopted by civilized nations anywhere any-where For all other offenses including murder the right of trial by jury is recognized 4 I recog-nized by the Russian code But political crimes including an attempt upon the life of the Czar or any member of his family no tribunal jury is allowed The trial is by military IT IS HELD IN SECRET and the judgment and sentence are frequently fre-quently prescribed beforehand In these political prosecutions the mere attempt noiJfollowcd by any result is punished to the same degree as the successful effort of death contrary to the doctrines of modern penal jurisprudence The point in the treaty which Russia considers of the greatest importance is that tl ti the United States shall declare that revolutionary revo-lutionary movements in Russia have politi lutonary cal meaning and that any attempt which shall endanger the Czars life even for the purpose of obtaining constitutional govern purose which is now denied in Russia shall be declared in advance by the American sha can declare it can people so fa as a treaty cn cn commit murder This is simply plotting t murer Thi a concession which the Russian government govern-ment has not yet got from any power except ex-cept Germany and Austria Recently the Russian government tried its utmost to influence England t deny the right of assylum t Russian political offenders but the British government remained true to her ancient traditional idea of assylum AJSTICLE SIX OF THE TREATY concluded between Russia and England February 218S7 says A criminal is not to bo extradited if the crime for which he is extraditable is deemed a political offense and he shall prove that his extradition is demanded with a view to prosecuting o punishing him for crimes of a political nature na-ture tureI the treaty is not rejected it will at least be so thoroughly emasculated by the elimination of the political crimes and other objectionable paragraph as to render it almost al-most practically worthless I is ascertained tonight that Senator Farwell did not vote against the confirmation confirma-tion of Halstead yesterday but was paired in his favor Still Discussing Murat Halstead WASHINGTON March 9The Senate was in executive session nearly three hours this afternoon and was occupied almost al-most entirely in considering the nomination of Murat Halstead to be minister to Germany Ger-many There were only five speeches made two of them by Hoar and Spooner in support of confirmation and the others by Teller Everts and Payne in opposition Senator Teller read Halsteads famous letter to Secretary Chase concerning Lincoln Lin-coln and Grant Senator Payne was very bitter in his tone He said that if the nomination had been to Russia with the proviso that he should go on to Sibera and never return he would gladly vote for confirmation Senator Evarts speech was long and said t have been emphatic in its opposition Senator Spooner in the course of his speech in favor of confirmation said that if newspaper men were for all time to be held to account for opinions expressed in the heat of campaigns but few could hope to pass unscathed into the golden realm of officeholding Senator Sherman desiring to respond to the remarks made against Halstead the Senate adjourned until 12 oclock tomorrow tomor-row leaving The sundry sun-dry civil bill as passed by the House contained con-tained an item of i > 000 for the construction construc-tion and improvement of suitable roads and aul roals anl bridges in the
