delay in the opening of the Third District Court yesterday morning caused by the absence I ab-sence of Mr Clarke who the Jude announced was detained before the grand jury I EDWARD RAWLINS I who had previously entered a plea of guilty of unlawful cohabitation was called for sentence In his behalf Mr Moyle made a few remarks as to the financial condition of the defendant and further stated that he had put the officers of the court to no trouble having hav-ing furnished witnesses etc without any hesitancy In answer to the queries quer-ies of Judge Sandford the defendant statEd that he was over 50 years of age had nothing to support his family fami-ly save his daily labor that his last marriage had been contracted in 1SS7 and his yo ngest child was 3 years of age He was sentenced to a fine of 75 and to be imprisoned seventyfive davs THE SWEENEY CASE was again taken up by the recalling of Annie A Martin the young witness who created such a sensation on Friday last and so sucos fully withstood the assaults of the defendants counsel She said that the sample of Rough on Eats taken by her from tie Sweeney household had been given taher sister Mis McCarty who had in turn given it to Mr Allison Mrs McOarty had been absent from the Territory since March last ME CLARKE then endeavored to have the testimony of Mrs McCarty as given before the Commissioner at Park City submitted as evidence MR HOFFMAN objected He did not believe the transcript was a legal one Such however was shown to be the case and the test mon in question was read to the jury Airs AltCirty testified in substance that her sister brought her the powder known as Rough on Rats and that she afterwards gave it to the prosecuting attorney of Summit County THE PROSECUTION RESTED and Mr Lewis made a statement of what the defense expected to prove He would show he said that the accusation accusa-tion was an idle slander that the defendant de-fendant and her husband and the entire family had lived happily together MRS SWEENEY tne defendant was called and there was a little buzz of excitement ex-citement as she took the stand In November last she said I was living in Ontario Canyon my husband Terrence Ter-rence Sweeney was ill last year and I called in physicians to see him Annie Martin was at my house during November Novem-ber last I remember sending Annie for two bottles of beer a pint of whisky an j a box of Rough on Rats I bought the pOison because we were overmu with mice and Annie said it wes good for them I on that day I went to call Dr Gregor I because I thought Terrence was not I feeling very well Dr Gregor was not in and i sent after him When I returned re-turned home I asked Terrence how he was feeling and he told me that Annie had said I was feeding him Rough Rats and I commenced crying Later in the day and next day Dr LeCompte came to the house The statement made by Annie that I put Rough on Rats oatmeal in tea and in milk and water is not true I had no such conversation with her as she alleged 1 have known her for about elevn years her reputation for truth and voracity in our neighborhood is bad I never had any R ugh o a Rats in the house till Annie she was 4 years old her reputation for truth and veracity in Park City has been bad Is that what you mean THE WITNESS Yes Laughter I know several people who have paid Annie Martin was untruthful Amone them Mrs McCarty Mrs Hurley and others I have been married to Mr Sweeney eleven years my first husband died about thirteen years ago he died of liver complaint after being ill thirty one days his life was insured for 1000 which I received I came west about seven or eight months after he died I had some friends and acquaintances acquaint-ances in Park City Mr Sweeney carries car-ries 2000 life insurance now that is made payable to me it was on Monday that I first went for Dr Gregor Terrence was very sick then he hid been ill for several months before that vomiting a great deal and with difficulty retaining any food on his atornach he first commenced com-menced com daining in July and was sick on and off until the middle of November No-vember Annie Martin never gave my husband any food before she came there L lr Mentor attended Terrence before Dr Gregor was called no one had prescribed for my husband previous pre-vious 0 Dr Mantor being called the Rouh on Rats I sent Armie to purchase was for the mice the beer and whisky wes for any one that should nappen to I need it I did not call at Martins when I was on my W1Y for the doctor he lived about a mile from my house I was gone about three hours from the time 1 first started for the doctor until I got back the doctor had been to see Tfrrence during my absence the night before I went to Wanship I spent at my own house I think I am not positive I did not drink anything on j Monday I was not in the habit of taking tak-ing any drinks regularly it is probable proba-ble that 1 frequently became intoxicated i intoxi-cated I did not think that Terrence was seriously ill and did not purchase any mourning apparelnot even a black vail Annie left mv house on Monday afternoon while I was away 1 I I did not have any woman in and my son Patrick purchased the tickets to Montreal Mon-treal I did not telegraph to my friends that I was coming I did not give my husband any Rough on Rats nor any other poison MR CLARKE Yon knew you were innocent in-nocent of the charge of administering poison then why did you want to runaway run-away THE WITNESS Because my sons wanted me to go It was not because I was afraid I was persuaded by my sons and was acting on the advice of Dr LeCompte mv son Patrick was to have met me at Evanston with the tickets for Montrear during my husbands hus-bands sickness I prepared his food frequently I gave him oat neal mush I never put pepper in his tea and never told Annie Martin that I did I co not know what ailment my husband was suffering from To MR LEWIS I heard the statement state-ment made by Dr Gregor concerning the swollen condition of Terrence he was not swollen any more than he would have been after a big drunk Annie and I had several quarrels while she was at the house To MR CLARKESweeney was present at the death of my first husband I came out here to marry Sweeney that arrangement was made about ten months after my first husband died the arrangement was made by letter about a month after my husband died I was not engaged to Sweeney before I married my first husband To THE JUDGEI did not pay Annie any wages for her services during the three weeks she was with moAt mo-At this point court took arecess until 2 pm and on assembling AFTERNOON SESSION JOHN SULLIVAN Am a son of the de endant was living with my mother at the time of the alleged poisoning am a carpenter and work at the Ontario mine He gave a description tf the house and the number of rooms in it I went into the cellar every day my mother and Terrence Sweeney lived happily together so far as I know I never saw but one box of Rough on Rats and that was the one Annie bought Annies reputation for iruth and veracity was very bad To MR CLARKEHave heard Jim Quigg say he would not believe Annie he said she would lie this was about six years agowhen she was 9 years of age I also heard Ira Collins make the same remark at about the same time when I said on Saturday last that I did not give mother any money when she went away I was mistaken I do not remember stating when I testified before be-fore the Commissioner at Park City that I could not remember any one person whom I had heard say that Annies reputation for truth and ve racitv was bad PATRICK J SULLIVAN Am a son of the defendant lived at my mothers home a year ago remember Annie Martin leaving the house and also remember re-member Terrence Sweeney being ill Annie was persuaded to leave by my sell and Terrence never saw any poison in the house until Annie Martin came there mother and Terrence I Sweeney lived happily together so far as I know during last yearsummer and fall Terrence Sweeney was sick I did not notice that his features were at all swollen or that hislimbs were Annie Martins reputation for truth and veracity is bad and bas been for nine years Terrenco Svee ey has been ill since that time but his illness was not of the same character TERRENCE SWEENEY Am the husband of the defendant lest summer and fal I lived in Ontario Canyon was first taken ill in July and was ill on and off till August 1 dont know just what was the matter except that I had been drinking very hard in August Dr Mantor treated me and later Dr Gregor and Dr La Compte were called in they wanted to see the medicine Mantor was giving me and I gave it to them they examined it and Le Compte said it was mercury and poison and that was what salivated me I dont know what he was treating me for this was in the last part of August Le Jompte went on giving me medicine and said I had the dropsy later I came to the Sisters Hospital whea Dr Fowler Fow-ler told me I was leaded I staid thereabout there-about ten days and then not getting aiv better I went home I told Le Jomflte what Dr Fowler had said remember re-member what Doctor La Uompte testified to in rescuing me from death ly putting on plasters and rubbing me with a stimulant that was inthe latter part of August I was lying on the bed on the 7th of November Novem-ber when Annie came in and said she had something to tell me but was afraid of the woman I asked her to tell me and she said the woman had beea feeding me Rough on Rats I said Is that so and Dr LeCompte was told the same story soon after that Mrs Sweeney came back and made mea me-a cup of tea and I drank it the next day Dr LeCompte and several others talked to my wife she left on the night of the 11th I believe went down and bid goodbye I advised her to go we had lived happily up till she day she went away her first husband died of liver complaint at least that is what the doctors said when I was ill I had racking pains some days feeling well I and others bad other people besides I Mrs Sweeney gave me food one night I was on a drunk in Park City and the next day I had a vomiting spell To MR CLARK I was healthy and strong up to my first sickness in July mv first illness first commenced after a I big drunk In August I was drinking heovily also in September I thought my iiCRness in November might have been caused by drinking I have been accustomed to the use liquors for many years I have been dr mk lately but it did not have as bad an effect II upon me as it did a year ago I never I had any quarrels with my wife about her drinking I have spoken to her about It however I advised the defendant I de-fendant to go away in order that she might avoid arrest I told Dr Le Compte that if she did give me Rough on Rats she must be a danged thief j I I advised her to go away but it was not because I had heard that he was I charged with poisoning her first husband hus-band in Vermont remember Dr I La Compte making the remark about I the bitterness of the soup and telling me I had batter not take it I To MR LEWIsAnnie and Mrs Sweeney had several quarrels before the former left when I asked Mrs Sweeney to leave she refused and would notgo however I Ihe defense rested and the prosecution prosecu-tion IN REBUTTAL called Annie Martin Who testified as to the distance Mrs Sweeney was away I < i F from her when she first put rough on rats in the food JAMES MOFFATTWas called and testified to the transcript of a portion of the testimony of John Sullivan taken at the preliminary examination was correct In this Snllivan stated that he did not know any one person who had said anything against the reputation of Annie DR GREGORYAm well acquainted in the community of Park City Annie Martins reputation for truth and veracity is good I never heard it called in question until she was summoned at a witness This closed the testimony and a sigh of relief went up from the iury box one of the jurors calling for a little more air It was given him and then Harrnel Pratt made the opening argument argu-ment He was fdlowed by Mr Hoffman Hoff-man for the defense andMr Clarke closed The charge of the judge was brief The case went to thejurors at 5 oclock They were out but a short time when they returned with a verdict of guilty as charged in the indictment Sentence will probably be passed on Thursday JAMES WOSTENHOLME who had entered a plea of guilty to unlawful un-lawful cohabitation was cilled for sentence sen-tence In his behalf Mr Moyle stated that his case was a rather peculiar one It appeared that he hadmarried his first wife in 1858 that in 1861 she left him as he supposed tor good in 1S61 he married again and in 1863 his first wife returned He had supported her since that
