The tenants demand Evicted tenants' rights compensation for their loss of residences. What are their rights? In federal district court the tenants complained that they had not been given federal relocation funds. The city gave such assistance only to those who would be evicted from buildings to be destroyed. Some of the property was just to be renovated. A judge ruled that since no actual "taking of property" had occurred, the tenants had an invalid complaint. A federal appeals court reversed this finding. It said a renovation was in ef fect a "taking of property." Urban renewal placed a heavy burden on the displaced dis-placed tenants while strongly benefiting all others oth-ers in the city, the court wrote. The city argued that it would illegal for it to allow tenants to remain in their houses. State law requires the evacuation of buildings found to be unsafe. For this reason they claim nothing was actually "taken" through eviction. The court rejected this reasoning. It said renewal was in effect private property prop-erty taken for public pur- pose.
