Show Uoundkeeoer of County Utah Territory Such bill of sale shall transfer and vest in such purchaser V the full title to the animals thus transferred trans-ferred If any animals thussold shall withinthe period of six months immediately I im-mediately ensuing after the date of the UUUil U Lil Uil U il u unidentified un-identified and proven as the property of any person it shall be the duty of the county court to forthwith pay the money received for such animals to their owner less the amount of costs I and damages as2ssed against the same but in the event said animals shall not be claimed identified and proven within said time then said money shall become the property of the county and shall be used by it for the purposes hereafter provided SEC HThe proceeds from the sales of said animals shall be paid into the treasury of the crfunty in which said sales are made to be used by it in the payment of persons employed in detecting de-tecting violations of the lawsof the Territory Ter-ritory of Utah It shall be the duty of the Treasurer ofeach county to keep in a separate fund to be known as the Livestock Fund all moneys paid to him under the proceedings of this act and ropay the amount only upon orders from the County Court duly attested by the County Clerk V SEC12 Tho fees of the poundkeen ers shall be as follows For registering horses mules cattle and hogs fifty cents per head and ten cents per head for sheep and goats for executing a bill of sale twentyfive cents for selling animals at roundups and drives ten psr centum of them the-m lnts received therefor Fees for eeuing anirnais snail DO governed by the market price of forage and pasturage past-urage at the time and places of the I same I SEC 13Any person otner iuSii r poundkeeper taking up animals under I he provisions of this act and retain lug them more than fortyeight hours shall be deemed guilty of a misdemeanor misde-meanor and shall be liable to a fine not exceeding hundred dollars for each animal so retained and all damages hat may accrue thereon SEC HAny person taking his own animals or that of any other person out of the custody of the person holding them for damage done by them or out of any pound by stealth or by force or shall intercept or hnder anyone while In discharge of his duty under this act may be fined any sum not exceeding one hundred dollars SEC 15Any person whose animals are JimpouQ ed may maintain an action agauist the ponndkeeper forclaim and delivery of personal property If npon trial It shall V appear that the animals were lawfully impounded the defend ant shall have judgment for such sum as shall be found due from the plaintiff for the damages for which the animals are impounded together lwith all the legal fees costs charges rand expenses and the costs of the action or instead of such judgment for i a return of the animals ti the defendant and he shall hold and dispose of them in like manner man-ner aa if no action had been brought SEC IGIf It sliaII ppearbli the de fault of the defendant qr otherwise that the animals Were taken without sufficient or justifiablecanse the plain tiff shall have judgment forhis dim ag caused by the unjust taking and detaining ana for his costsOf suit SEC 17If aggrieved person shall proceed by action against the owner or I person in charge of trespassing animals ani-mals he shall get two disinterested perSOnS I per-sons of his precinct to appraise the damages and to give him a certificate writing V under their hands i I which cerlificaje t aBHIL accompany the complaint g part thei bf and under I no circumstances shall he recover of the defendant in such action unless I I such appraisal and certificate shall be made within fen days after the time of I I such trespass was committed nor to a greater amount of damages than the I I amount named such certificates V SEC 18 ThatSections C2and 3 of an j act pertaining to damages done by animals and defining a lawful fence ap I proved February 17 1869 are hereby stricken out with the exception of the I enacting clause and an act establish lug district and precinct pounds and I prescribing regulations for conducting the same and for disppsingof estral animals approved February 13 1872ls hereby repealed Nothing herein shall be construed td interfere with he rights oMncqrnoraled cities and towns tofreE ulate imponpdTng of animals and dil posing of the same V |
