Saturday and with the greatest difficulty those entitled 18 admission could force their way through the corridors to the criminal court room The opening of the court room was delayed de-layed Borne minutes in consequence Guitteau arrived in the van at 9 oclock having an escort of three mounted policemen po-licemen in addition to two officers on the Tan He was at once takeu to his room where he breakfasted and read the morn ng papers He seemed to have recovered entirely from his scare He attributes his escape on Saturday to the interposi tion of the Deity and desired his hearers to understand that he was not afraid to die if the Deity desired it but de did net want to be shot down like a dog before he had time to fully vindicate his conduct con-duct in a court of justice Upon being brought into court Guitteau at once the voted himself to his papers and contrary to general expectatien made no demonstration demon-stration whatever or allusion to the late attempt upon his life Immi diately upon the opening of court Robinson arose and addressed the court for the purpose of calling attention Ito I-to an article in the Sunday fast in which Scoville was made to say that he should request the withdrawal of Robinson from the case as be Scoville had become Eat ified i that Robinson could be of no assistance as-sistance but rather an embarrassment in the conduct of the defense Robinson criticised in severe terms the discourtesy he had received by Guitteau who broke in with Your honor 1 want Robinson Robin-son to stay in Continuing Robinson requested the court to grant his discharge from the case and positively stated that be could not with proper self respect remain in association with Scoville Guitteau who had been closely following Robinson all through the latter portion of his speech broke in again and with considerable warmth said That is an able speech and I agree with most of it If he had only made it last Monday there never would have been any disturbance dis-turbance between us Scoville here tried to quiet Guitteau when he retorted upon him Keep quiet yourself Im talking now I sympathize with him in this matter Scoville made a brief statement deploring de-ploring the disagreement after which Judge Cox relieved Robinson from further fur-ther connection with the defense Sco ville began to address the court with I We do not expect to oe compelled to conduct the case entirely without assistance assis-tance Here Guitteau exclaimed I understood Judge Magruder was anxious to assist in this trial also Mr Townsend I should like to have them appear here as well as Sweett or Story of Chicago Then adding after a pause On the question ques-tion of malpractice my idea is simply this that by the physicians own statement on the 25th of July the President Presi-dent was not fatally shot We do not want to press the subject but desire to have it go on record so that the court in band may take notice of it After a brief pause Guitteau added That ii all there is to the malpractice business short and to the point I want it understood that I appear as my own counsel here I am the agent of the Deity and I expect him to take care of me I think he has managed it pretty well so far The district attorney then called Drs Woodward and Lamb who testified to the qharacter of the wound that it was a mortal l one They also identified the ball which was exhibited to the jury a th > one they had taken from the body of President Garfield The poecution thea rested their case Guitteau was allowed jormusioa to bo heard in opening defense de-fense Guitteau retaining his seat began Your honor I was not aware that I was expected to speak this morning Sco ville here leaned over and whispered to him when Guitteau retarded sharply and witn impatiencE I wont standup stand-up Im not afraid to however but I have only a moment to speak and will keep my seat I do not care to say more than WR published last Monday in my address to the public I presume the jury all siw it I have no set speech to make I appear my own counsel and my idea is to make corrections as we go along just as we have done the past threo or four days I dont mean any dis courtesty to any one 1 only wanted tot g to-t at the facts If any one says 1 owe them 520 and I dotit I will deny it on the spot My idea is to take things while they are hot and not let them get cod and suffer from misrepresentations Of course I shall go en the stand at the proper time and be examir ed and cross examined My ideM however is to meet a misstutement when it is i hat instead in-stead of waiting to lot the matter get digested and understood I think the I true way is to make my statements as the case proceeds I have no el speech to maKe but urn much obliged to your honor and to my counsel for the courtesy of this invitation Guitteaus manners seem to have undergone a marked change since the early days of the trial and during the delivery of his short speech this was particularly noticeable At the conclusion conclu-sion he settled hack in his chair with an air of exhaustion and rested his head on his hind wearily while a careworn expression ex-pression appeared upon his face Scovillo then addressed the jury at considerable length Much he said had been introduced intro-duced in evidence thus far which to his mind should have no bearing upon the case All men hared the same opinion relative to the suffering of the Presiden It was not pleAsant to contemplate these things and when they were presented to the jury they must exercise an influence The only question however for the jury to consider was whether the prisoner killed the President and whether at the time he was in euph a condition mentally as to render him responsible for his action The speaker with no attempt at oratorical effect presented in a plain matteroffact manner the points which he prooosed to make and upon which the defense would rely Without concluding con-cluding the opening address Scoville requested re-quested the court to allow him to finish tomorrow This was granted Adjourned |
