Show Governor Told That Legislature Legisla-ture Can Ratify Without the Vote of People WASHINGTON. June 24. Assistant' : Attorney General Frierson' has advised : Governor Roberts, of Tennessee, that jtli'o legislature of that state could rat-Ufy rat-Ufy the suffrage amendment without submitting the issue to the people. I Mr. Frierson was based largely upon I the decision of the supreme court in i tho Ohio referendum case. In that 'case the court held thit ratification iof amendments could be had only ny I state legislatures or conventions and I chat provisions of state constitutions 1 fta: i.;ti.t:cycion bp referred to ajvott-'of ajvott-'of the people conflicted with the federal fed-eral constitution. Mr. Frierson. who is a natlvo of i Tennessee, ruled that the supreme decision de-cision made invalid that section of I tho Tenncsse constitution which pro-Ivldcs pro-Ivldcs that any action on a feder.il ,amondmont must be taken by a legls-I legls-I Iature. the members of which have been elected after the amendment w-isi 'submitted to the state. Miss Alice Paul, chairman of the Woman's party, said today that Gov-jernor Gov-jernor Roberts' decision to call a spec-clal spec-clal session of the Tennessee legislature legisla-ture to act on the suffrage amendment "means certain victory." A recent canvass of both Tennessee houses, she said, "yielded a safe majority in favor of ratification." "This, of course, will be a triumph for tho Democratic party," Miss Paul declared, "and already has had the effect of pushing Republican efforts to secure action in Vermont." Workers Are Hopeful. NASHVILLE. Teun.. June 2 1. Suffrage Suf-frage hopes rallied today when it was learned Governor Roberts planned to call a special session of the legislature legisla-ture to act on the federal suffrage amendment following receipt of a telegram tel-egram from President Wilson urging such action. The governor, however, did not comment com-ment on the constltutlonalityof tho legislature's act should a favorable ote be reached. Tho question of constitutionality hinges upon a clause In the state constitution, con-stitution, which provides that action on a federal amendment must bo taken tak-en by a legislature, the member:;, of which have been elected after the amendment was submitted . to the stale. Members of tho present legislature legis-lature were elected previous to submission sub-mission of the suffrage amendment. |
