Show BRSGHAMGITY Formal Opinion on Census Result Re-sult Given by Attorney General SALT LAKE, June 21. Brlgham City is now a city of the second class by reason of the recont federal census In the. opinion of Don B. Shields, attorney at-torney general of Utah. A formal opinion on the subject wa- rendered to Ma) or J. W. Peters of Logan, after being be-ing prepared by Oliver C. Dalby, assistant as-sistant attorney general. The opinion meann that Brlgham City will get the commission form of governement, required by law for cities of the first and second classes, and also that it will have control of its own schools, separate and apart from the Boxelder county school district, dis-trict, of which lirigham City has heretofore here-tofore beena part. Mr. Dalby points out that the statute provides that when a city of the third class, such as Brlgham City lij, Hhall have attained a population of 5000 or more, and such fact shall have been duly ascertained and certified to the governor by the mayor, the governor "shall" declare by public proclamation, proclama-tion, such city to be of the second flaps. The dividing line between cities of the second and cities of tho first class is 50.000 population. |
