Sheppard at the Wellington hotel in the ftarly morning of July 19. last, for the alleged wrongdoing of his wife, who left him for Sheppard. is free until his trial for tho crime, although he is charged wifh the hipiiest crime In the category, murder In tho first degree. In District Judge Armstrong's court Monday Jones was admitted to ball in the sum of $5,000 upon application of his attorney. M. M Warner. Tho sureties sure-ties on Jones' bond are Samuel New-house. Woodruff This Is one of the few cases In the history of the state of I'tah in which a defendant charged with ilrsi degree de-gree murder has been admitted to bail. Here is the section of the state, statute, No. -lStSu, under which bail In such a case may be taken; "A defendant charged with an of-.fense of-.fense punishable with death may be admitted to bail only by a judge of the supreme or district court. When, however, the proof of his guilt is evident evi-dent or the presumption strong, ball shall not be taken. The filing of an information or the finding of an Indictment In-dictment shall pol add to the strength of the proof or presumption to be drawn therefrom." Jones was exonerated by a coroner's coron-er's jury, which said that the killing of Sheppard was justifiable, homicide, but County Attorney Job P. Lyon refused re-fused to abide by this verdict, on the grounds that the murder was premeditated premedi-tated and cold-blooded, and Issued a complaint against Jones, charging him with first degree murder.
