Query I married a soldier of the war of the rebellion. He served three years in said war and I am his second sec-ond wife, having married him in Sep- ""J tember, 1S95. I have two children by him, aged three and six years respectively. respec-tively. My husband was also in the regular army from January 22, 1S66, to July, 1S73. He now receives a pension pen-sion of $50 dollars per month. I am told that if he should die. that neither I or my children would get anything in the way of pension because I married mar-ried the soldier after 1890. Please give me some information in your pension column about my title to pension pen-sion in case of my husband's death. Mrs. R. B. Answei You will be entitled to widow's pension under the general law, if your husband dies from the disability for which he is pensioned under the general law or from disability disa-bility otherwise due to service and line of duty. You would not be entitled en-titled to widow's pension under . the act of April 19, 1908 (which is allowed without reference to the cause of the soldier's death), as you were married to said soldier subsequent to June 27, 1890. Query My husband was a pensioner pension-er at the rate of $50 per month and he died from the same disability for which he was pensioned, and I only draw eight dollars per month pension as his widow. I married him in 1888, and he was a private soldier in the war of the rbellion. Please advise me why I do not receive the same rato of pension which my husband received. re-ceived. Mrs. Mary J. McD. Answer The rate of pension allowed al-lowed a soldier has no bearing on the rate of pension allowed his widow, wid-ow, which rate is fixed by law. You are now entitled to $12 per month pension under the act of April 19, 1908, if you were on the pension rolls at the date of the passage of said act. You were properly pensioned pen-sioned heretofore at the rate of eight dollars per month under the general law, as your marriage to said private pri-vate soldier of the civil war occurred oc-curred subsequent to March 19, 1886. Chicago, 111. Query My mother married a soldier of the civil war in 1863. He died about, two years after his discharge from the United States service. She received a pension on account of his service up to the time she married her second husband in 1889. She lived with her second and last husband to 1892, when he got a divorce from her upon grounds unknown to her.' She is In poor health and circumstances. Is there any way that she can get back on the pension rolls? Herbert G. A. Answer Your mother is not entitled en-titled to restoration of pension under the act of March 3, 1901, on account of the service of her first husband for the reason that the divorce from her second sec-ond and last husband was not granted lo her upon her own application, which is necessary to obtain the benefit pf the provisions of the act of March 3, 1901. It Is Impossible Im-possible for him to prove that he contracted con-tracted any particular disease In the service, but he Is suffering from general gen-eral debility and Is unable to do any work. Answer The sailor cannot secure pension unless he can prove lhe origin of a specific disability In the service and line of duty and the continuance of the same from discharge lo the present time. He can, however, apply to the secretary of the navy for aid from the naval pension fund, as provided pro-vided by section 4757, United Slates Revised Statutes, on account of his ten years' service In the United States navy. Answer The widows of soldiers and sailors of the civil war are entitled en-titled to pension tinder the act of April 19. 190X. without proving death to have been the result of army or navy service, provided said soldiers or sailors served 90 days In the civil war and received an honorable discharge therefrom and that the said widows married their said soldier or sailor husbands prior to June 27, 1890. Twelve dollars per month Is the rate of pension allowed under said act of April 19. 1908. from the date of the filing of application in the pension bureau. |
