new york life insurance company who according to testimony has been en trusted with hundreds of thousands of dollars by the company and has not accounted for has been heard aiom by the legislative committee but has declined to make an accounting A statement by mr hamilton was read today it was presented by secretary john C mccall or the new york lite who went to paris to secure an accounting from hamilton in hh statement mr hamilton says that he Is unable to produce any books or accounts because he undertook the legislative matter for the life insurance company with the express understanding that he was to make no accounting absolute secrecy was necessary in retaining assistance therefore no checks were used in making payments mr hamilton went into an explanation tor the reasons of organizing this confidential service as he characterized it covering his methods of work and citing a number of legislative bills in which he had been interested A list of expenses from 1899 to 1904 was appended to the statement tha sum of unaccounted for he says would be greatly reduced by his running account which still is unsettled and open and ai a matter of good faith pending a settlement he offers to deposit with the company secretary mccall was questioned by mr hughes as to what further light he could throw on the statement of mr hamilton but he said he could give no information he did not question mr hamiltons figures nor the large amounts for traveling expenses he asked mr hamilton for n full statement otate ment and relied on hla honesty to explain everything he did insist that mr hamilton produce checks or check books but mr hamilton said he had none when mr wes excused henry D appleton of the state insurance department was called he completed his testimony begun last friday and during the examination was told that air morgan former president of the bankers life insurance company bad testified that sir appleton said it would coit co it the life to reincorporate mr appleton said if mr morgan said that be Is a liar louis F payne former of insurance of tho state of new york was called to the stand and explained a large number of appointments of confidential examiners on the ground that a large number of examinations were made during bis term of office mr hughes produced a list that show that in 1837 two examinations were made and in 1898 two more were made while in 1899 the last 0 mr paynes administration the number had not been brought out when adjournment was taken the affairs of the mutual reserve life company were taken up the and during this line of examinations mr payne stated that he had been opposed to mr burnham as president of the mutual reserve and said he tried to get him out mr ached why he had tried to gel him out and hamilton did with this money witness replied that it was henry D appleton deputy in superintendent perin office resumed the testimony which was interrupted by adjournment last friday mr hughes read a letter from the yi delity lite insurance company in which it was charged that the insurance department had revoked its license under the stipulated premium law mr appleton had no recollection of the matter did you state to richard morgan of the bankers life that it would cost for no and it mr morgan says so or it anybody else says so he Is a liar answered the witness mr morgan made that statement replied mr hughes then he Is a liar replied the witness no controversy here said chairman armstrong former superintendent of insurance louis F payne was then called ho mild he was superintendent of insurance for three years and retired in february 1900 he said that none of the confidential examiners who were by him were chosen upon suggestion of any insurance company there were seven of these examiners during mr paynes administration and the force had to ie enlarged because a great many companies had to be examined mr payne said ho went into the department part ment with no knowledge whatever of insurance he did not assume any direction of examinations the ex made during mr paynes were upon it was brought out that among the companies not examined were the equitable germanda Ger manla home manhattan metropolitan united states and washington lite in 1897 only tho american union and the provident savings lite were examined in osos the mutual reserve and the security mutual of binghamton were the only ones examined in 1899 mr payne said the mutual lite was examined abc tho request of president mccurdy witness said a request was unusual but mr mccurdy was afraid ot some western departments aaker what he was afraid of mr payne eald all these corporations are afraid of strike legislation and of some departments then there are plenty of agencies that strike these companies the are cowardly there were seven of these commissioners ners from other states that wanted to examine the mutual life at that time but the nw york department conducted the examination with a delegate from the other states looking on j mr payne testified that the examinations the department looked only into the solvency of companies mr said ho knew of andrew C but had not been acquainted with him he knew felda represented the mutual at legislatures it never occurred to mr payne to instruct the chief examiner to look into the legislative expenses of the mutual in this examination the new york lite was also examined in that year witness did not remember why this wab done he knew andrew hamilton very well he knew ho was employed by the new york life while everything he did appeared to be in the open said mr payne 1 I could put two and two together and guess that he wa doing some things that I 1 did not know about mr payne said he thought the committee should draft a bill to stop lobbying by insurance representatives ha would be glad to assist the commit tee all he could what would you suggest mr hughes asked 1 I would be to make some sug gest ions after an opportunity to things over you think it ought to be stopped 1 I know it replied the witness amid the aughter of the committee and spectators the mutual reserve was again examined in 1899 the witness said because of information and complaints received by the department some of theae complaints cama from officers of the company 1 I had hoped to get things in shape 0 o as to get president burcham out of the company said sir payne why did you want to get him out mr hughes asked because I 1 thought him a crook responded mr payne ho said it was after this examination that the report was turned over to the attorney general adjournment was taken until tomorrow when mr will resume hla testimony |
