Show BEFORE THE COMMISSIONER. Testimony as to the Assault Upon nr.-Dickson Being-Taken This Afternoon. The examination which was set for 10 o'ciock this morning, in the case against S. A. Kenner, Frank J.. Cannon and Angus M. Cannon, was postponed till 11 j a. m., and finally to 2 o'clock this afternoon, after-noon, owing to Commissioner Critchelow being detained in the court chambers in a case for which he was retained as counsel. coun-sel. The case against S. A. Kenner was the first one called up, on the charge of being implicated in a conspiracy with the Can- nonb to murder W. II. Dickson. " Mr. Kenner requested, through his attorney, Presley Denny, to have a separate examination. exam-ination. Mr. Varian, who prosecuted the cases in the absence of Attorney Dickson, objected to allowing this," and requested to be shown the statute, it such there were, - providing for it. Commissioner Critchelow sustained the objection, and after Mr. A. S. Patterson was summoned to report the proceedings, the cases were opened jointly. W. H. Dickson was sworn as the first witness : I live in Salt Lake City, at the Continental Hotel. I took dinner on Monday evening, and left the dining-room dining-room about 7 o'clock, in company with my wife and children. I was acquainted with Kenner and Angus Cannon, but not with Frank. As.I came out into the hall I noticed two persons standing by the news stand. I heard some one call my name, and turning towards these two parties I asked what was wanted. One of them asked me. to come out ; that they had a pointer to give ine.'I proceeded with them out at the front door of the news stand. When I got outside I inclined in-clined my head towards Frank Cannon, expecting to hear what . he had to say. I felt something on my shoulder, but don't know whether Frank Cannon had hold of me or not. It was all done in a moment. The other party struck me two quick blows on the left eye, and as he did so I grasped for him, but got hold of Frank instead.- I held him for, several moments and demanded to know who had struck me, and where he was. He refused to tell me. Cross-examined I had no conversation conversa-tion with Frank Cannon that I remember. It was the other party who did the talking talk-ing near the news stand. Both of these persons went out of the door together ahead of me. I do not know who it was ' that took hold of me outside, when the blows were struck. I saw no communication made . between the two. Frank struggled to get loose from me, did not notice that he had made any special effort to get away before this. I did not see Kenner nor Angus Cannon there. Excused. Charles V. Smith was called : I am driving the delivery wagon for Remington, Reming-ton, J ohnson & Co. I was going past the Continental Hotel last Mondav evening, and when a little north of tlie place I heard a noise, and upon turning saw some kind of a row on the porch of the hotel. Also saw a man jump over the railing and run .across the street. Upon going up tothe place, I saw Mr. Dickson Dick-son holding a man by the throat, shaking him. I did not-recognize the man. I saw a man in the street throw a rock into the crowd, but don't know who it was. Mr. Rawlins, for the defendant Frank J., objected to the evidence in relation to this party, and objection overruled. over-ruled. I saw the rock passing through the air just a few minutes after I had seen the man jump over the railing and run out in the street. Cross-examined I did not srr wliro the rock struck, but heard a crash immediately im-mediately afterwards. I only saw one man running away from the hotel, but noticed a number going towards the scene of the disturbance. It was after I had seen the man jump the railing that I noticed Mr. Dickson holding a man by the throat. Excused. Geo. S. Erb testified: I got to the Continental hotel about 7 o'ciock Monday Mon-day evening. I first saw Mr. Dickson with his family coming out from the dining din-ing room. I noticed two men in the hall, and recognized one as Frank Cannon, but did not know the other party. I had noticed them first in company with Angus Cannon, Jr., in front of the I hotel bar. Angus came" up and I shook hands with me. The other two were the same that I saw later near the news stand. Shortly after my entrance I heard Mr. Winslow, the clerk, say that the parties wished to see Mr. Dickson. I followed them through the hall as they went out with Mr. Dickson, and saw Hugh Cannon taking something out of his coat pocket I don't know what. As I got to the front door I saw Hu"h striking at Mr. Dickson, and I put forth my liand to catch his arm, but my hand was struck down. I afterwards took hold of Frank Cannon about the time Dirl-smn also took hold of him. The clerk came out at this juncture, and also Angus Cannon, Can-non, Jr., came up and struck, as it appeared to me, at Mr. Dickson. I took hold of Angus, and in the tussle he tripped and fell, and I also fell on my hands. I saw Mr. Porter and some other gentlemen and asked tU Pin in hrJrl i Angus, as I wanted to go where Frank was struggling with Mr. Dickson lohceman John Y. Smith came up at this time and took Frank Cannon off I heard a good deal of talk between Frank Cannon and Mr. Dickson, the 'former refusing to tell who it was that bad struck Mr. Dickson. I heard Frank say: "G-d d-n you, j I will get away with my man yet. Marshal Mar-shal Ireland came soon afterwards and Angus was taken in the hotel. The action of Hugh Cannon in taking' something some-thing from his pocket attracted my attention, at-tention, and that led me to follow them Cross-examined The younger man opened the door with his left hand and went out first, followed bv Mr. Dickson and Frank going out last. They were all three close together as they passed out I was almost near enough to them to catch the door as they closed it. I didn't see Hugh take anything out of his pocket,but I felt sure that he had something when lie struck,as the blow on my head seemed to have come from something hard. The skin was taken off mv knuckle by the stroke. Frank Cannon had hold of Mr Dickson's left nrm nnd haA at the latter's back. Hugh Cannon was immediately m front of Mr. Dickson when he struck. I could not see whether Angus Cannon had his hand closed or open when he struck at Mr. Dickson. Ihe examination was being continued wnen the Democrat went to press. |
