Show A 'NEVADA RAPE CASE. ! Judge Boardman Gives a Washoe County Jury His Opinion of Them. In the District Court of Washoe County, on Saturday, on motion of the District Attorney, the second charge of rape against Frank Borden was dismissed on the ground that the girl upon whom the alleged assault was . committed was over 12 years of age. The Judge granted the motion, but said: "I am satisfied the child in testifying that she was oyer 12 years old swore to a deliberate lie. I don't blame the girl, because I am satisfied satis-fied that she was educated by her parents to so testify." In commenting upon the action of the two juries in the other case the Judge said: "The jury disregarded the law ; they disregarded the testimony, and they disregarded their oaths as jurors, and I want it distinctly understood what I think about it; A jury of WaBhoe Indians In-dians would have done better. I am ashamed of. the county, I live in." etc. He then severely reprimanded the defendant de-fendant and ordered him discharged. Virginia Chronicle, 28th ult. |
