Show > r EI EZZLEME r The Cal g Preferred against Edward Austin Austin Arrested and Admitted Aust to Bail Adtd 5000 Misappropriated The most exciting event that has stirred Salt Lake for several weeks transpired I this morning About 1130 a rumor reached the ears of the DEMOCRAT repor porter that Edward Austin late manager of the London Bank of Utah had been arrested or was about to be arrested for embezzlement The reporter rushed to Marshal Irelands office and inquired I I what foundation there was for the rumor Well you newspaper fellows beat everything said Marshal Ireland We dont have more than time to wink twice before some of you are after us I cant understand how you learn everything so quick I dont know whether f Austin has been arrested but i he has you will probably find him at Commissioner McKays office The reporter awaited to hear no more but immediately started for Judge McKays temple On the way he encountered en-countered Mr Austin who with Deputy Marshal Vandercook it was afterwards learned was searching for bondsmen It was learned at Commissioner McKays office that Austin had been arrested ar-rested and Monday morning at 10 oclock set for hearing Bonds were fixed at 1500 and Austin was at that time inquest in-quest of sureties The complaint was found in the law office of Marshall Boyle Mr Austins attorneys who allowed the DEMOCRAT reporter re-porter to note down the contents It reads a follows KSS4 To William McKay Esq Commissioner of the Supreme Court of Utah Territory Sarah J Williams now of Salt Lake City in the County of Salt Lake and Territory Ter-ritory of Utah on behalf of the people of said Territory on oath complains that Edwin Austin of Salt Lake City on the first day of October 1884 at Salt Lake City did embezzle a large sum of money towit the sum of five thousand and one hundred dollars of the money of the said Sarah J Williams in the manner and form following that is to say The said Edward Austin at the time and place aforesaid was the trustee and agent of the said Sarah J Williams and as such trustee and agent there and then entrusted en-trusted with and had in his control the said sum of five thousand and one hundred hun-dred dollars for her use and the money and property of the said Sarah J Williams and being so intrusted with and having entire control of the said money he the said Edward Austin did then and there fraudulently unlawfully and feloniously felo-niously appropriate the same t his own use and benefit SARAH J WILLIAMS Complainant Mr Austin appeared at Judge McKays office about noon with Messrs Henry and Chas H Denhalter who appeared as bondsmen Mr Austin was encountered encoun-tered by a DEMOCRAT representative shortly afterwards but acting under the advice of his attorneys he declined to give any account of his transactions with Miss Williams In conversation with a DEMOCRAT DEMO-CRAT reporter a few days ago on this subject sub-ject Mr Austin claimed that instead of misappropriating any of Miss Williams funds that lady was indebted to him in the sum of several hundred dollars Messrs Marshall Royle denounce the whole proceedings as a most infamous outrage They allege that Mr Austin was entrusted by Miss Williams with certain sums of money for invertment that he purchased certain mining stocks with a portion of the money at the regular cur rent price These stocks afterwards deprecated de-precated in value and Miss Williams was trying to shift the responsibility of such depreciation upon Austin They also allege I al-lege that Austin had attempted to refund her certain sums of money but had been unable to find her That he sent her a remittance which was returned through the deadletter office I is hard to reconcile rec-oncile this latter statement with that made by Mr Austin to the DEMOCRAT reporter re-porter in which he claims that Miss Williams Wil-liams owed him several hundred dollars Messrs Williams and Young are attorneys at-torneys for Miss Williams and her story differs materially from that of Mr Austin Aus-tin She claims that she intrusted Austin Aus-tin with various sums of money which he was to invest in loans that she called upon him to return 5000 which he failed to do Miss Williams is a resident of Springfield Spring-field Mass and arrived here during Mr Austins absence in England for the purpose of investigating affairs She went away when she found that Mr Austin was not here but returned as soon as she learned he had got back Miss Williams is an I D and has accumulated her wealth by her own efforts A few minutes conversation with her is sufficient to convince one that there is no demned nonsense about her and that she knows what she is about The high position occupied by the defendant de-fendant both in social and financial circles cir-cles invests the case with more than usual importance It would b an injustice in-justice to Mr Austin to prejudge the case and the DEMOCRAT hopes he will be able satisfactorily explain his course |
