Show DUNN AND DEAN The Former Sentenced the Latter Being TTried Tne Testimony of Mr Dean and Mrs Ridges After the disposition of the Eardley case at the afternoon session of the District Dis-trict Court James Dunn was called for sentence Mr Dickson arose and asked the Court to be as lenient as consistent with this defendent for the reason that he had thrown no obstacle whatever in the way of the prosecution Mr Dunn arose and in answer to the question of the Judge as to whether or not he intended obeying the law in the future he said that his belief would not permit him to make any promises The Judge then sentenced him to serve a term of six months imprisonment on the first count of the indictment and a term of three months on each of the other two and to pay a fine of 100 on each count making in all one years imprisonment im-prisonment and a fine of 300 and costs of prosecution JOSEPH II DEAN Who slipped through by the disagreement disagree-ment of a jury at the last term of court was then called for trial The witnesses were called and the jury empaneled Louis Bamberger had a presumption of guilt and was excused S C Pancake E M Bynon and George Shell were excused on a peremptory challenge The jury then stood as follows Alfred Thompson George Mullett S C Underhill James Winchester George Morrison Albert Fisher M Dusseldorf J B Wilson R P Martin Joseph Foster J M Harvey William McCrea The clerk then read to the jury the indictment in-dictment which contains but one count and charges the defendant with living with Sarah Allen Dean and Florence Ridges between the first day of January 1886 and the first day of April of the same year The taking of evidence was begun by Mr Dicksons calling SARAH ALLEN DEAN Mr Rawlins objected to this witness being forced to testify on the ground that she was the defendants legal wife Mr Dickson said that he would admit the fact and the Court stated that the witness might testify under the restrictions restric-tions named in the Eardley case Witness saidDuring the time named in the indictment I lived in this city my husband lived with me during that time am wife of the defendant know Florence Ridges have known her since she was a child she was living at my house at the beginning of the present year she visited me in February for a few days she commenced visiting about six months before she came there to live prior to those calls we never exchanged visits I did not return her calls my husband left home for Cache Valley in June of last year dont know that he went to Logan he went one morning and returned re-turned the next evening have never heard of Florence Ridges since I last saw her in February Crossexamined by defenseMy husband hus-band said he went to Logan on business for her father Redirect by prosecutionHe has never before gone there on business for his father that I know of dont know what the nature of the busines was To defenseFlorence Ridges was at my house to assist me in dressmaking To prosecutionThe contract was that she was to have onehalf of the gross proceeds she had a room and board without paying for it it was agreed that she was to assist wiEr the housework as an equivalent for her board and lodging did not speak to my husband about it have been married ten years do not remember that Miss Ridges was ever at my house prior to last year I had called upon her folks at her home this was a number of years ago Excused MRS AQATHA RIDGES Was next called She said I am the mother of Florence Ridges she is 19 years old 5 Here Mr Dickson asked for a descrip tion of Florence and the mother stated that she was of medium height rather slight has blond hair has a mole oa her J neck Witness proceeded in answer to the questions Florence made a visit to Logan in June 1885 she has relatives there she was gone about three days she has never been there before or since to my knowledge she had lived with me up to tans time she has worked at dress makMsg with me ahe had never gone out to work before that time she went to live at Mr Dean house about a week after her retun from Logan she remained re-mained there until the beginning of this year she then came home and stopped i a few days she then went to Davis county she returned to my house some time in February she remained a few days she then went back to Mrs Woods in Davis county I saw her some time in June of this year she remained a day and a night at my house did not see her betweeen February and the latter part of April received a letter from her during the periodmentioned do not know where Florence was aj any time between the last of April and June of this year have not seen her since that time dont think Ive heard from her at all since June The testimony of this witness was still being taken when our report closed |
