Show Iss THE INVESTIGATORS Impaneling a Grand Jury for the Aril L Term Four Mormons Who Do Not Believe in I Polygamy The April term of the Third District Court which will be the most important of the year commenced at 11 oclock this morning There was a pretty good attendance S at-tendance of spectators as it was known the periodical and interesting impaneling impanel-ing of a Grand Jury would take place The first business transacted was the admission of a citizen after which 0 P Arnold was arraigned which is noticed elsewhere I The names of those summoned as Grand Jurors were then called as follows fol-lows 28 Peter A Bird 142Joseph II Grant 150 Thomas Rogers 30 Henry Heath 23V A Cook 1831 W Cottle 49George Barton 182James howell 137 Charles E Michener 11G Andrew Helm 5 53Y P Noble 12 Stephen Hunter 151 K Gillespie Andrew Cowan 34 Thomas C Hull 1 Stephen Beard Peter A Bird was absent and Henrj Heath was excused IJY reason of his important im-portant position as night watchman Jacob Shurt was called in Air Heaths place with and the examination was proceeded I Joseph 11 Grant was the first victim impaled by Mr Dickson He possessed pos-sessed the usual statutory qualifications qualifi-cations and did not believe polygamy polyg-amy right although he had been educated edu-cated to believe it so If sworn as a Grand Juror he would not inform his fellow jurors of any man who he supposed sup-posed to be living in polygamy lIe would inform them if he thought a man had committed murder or any other offense but would not inform on polygamists polyga-mists because he did not want to see them prosecuted He was excused Thos Rogers of Farmington was taken up He believed polygamy was right until the law came out against it Being further questioned he confessed that he believed in the revelation sanctioning sanc-tioning polygamy and believed it rignt for a man to obey it Excused I Walter A Cook of Park City was not a taxpayer Had no money or other property and was therefore allowed to retire J W Cottle of Salt Lake was the next on the list He was not certain he was a citizen and was excused Wm Barton W P Noble and James 1 Gillespie of Salt Lake and C E Mich ener of Stockton passed through the ordeal unscathed and were accepted James Howell of Tooele City stated that since the law against polygamy was declared constitutional he had studied into the matter and had come to the conclusion con-clusion the practice was wrong He had been a member of the Mormon church since 1842 but did not know whether he believed the revelation concernim nnlvr amy came from God He did not land knov l-and consequently didnt believe either way After further and rigid questioning Howell admitted that he did not believe any such revelation was ever given and if sworn as a Grand Juror would inform his fellow jurors of any case in which he had reason to believe the law against polygamy was be ing Violated and would furnish the names of those who lie believed could furnish information if called as witnesses wit-nesses He would proceed against Apos tie Lyman as quickly as against anyone else He was accepted Andrew Helm of Mill Creek believed it right for a man to have more than one wife if his religion taught it Excused Stephen Hunter and Andrew Cowai were polygamists in theory and their chairs were vacated Thos C Hull of Salt Lake did not believe polygamy right Thought it 5 would be morally wrong in the absence of all law against it He did not believe any revelation commanding it had been given by God but thought Joseph Smith might have been mistaken Accepted Stephen Beard of Mill Creek was a member of the Mormon Church but be lieved polygamy morally wrong If sworn as a Grand Juror he would be as zealous in enforcing tile law against polygamy as any other Accepted Jacob Shurt also answered all ques tions satisfactorily and was accepted This exhausted the panel and eight jurors were secured four of whom are Mormons and four Gentiles A special venire of fifteen names was ordered and the following names were drawn A B Stout Isaac Jennings J H Poulton Lorenzo D Young A L Harding John A Blye Robert Turnbull Win Grimsdell jr B L Dickinson W F Martin L J Ruth J Lovendale B S Young Louis Cohn James Dwyer M H Lipman The venire was made returnabfe tomorrow to-morrow morning at 10 oclock |
