Show TO IllS CREDIT It is to the credit of Judge Zane that in construing the laws here and more particularly par-ticularly the Edmunds law His Honor has not been one of those who had to wait until some one else showed him the path that he might walk in it In his construction of the cohabitation clause of the Edmunds law Judge Zane has been followed by the Chief Justice of Idaho and one Associate Justice Jus-tice of Utah He has also been followed fol-lowed by the courts in Arizona and it I is probable that if tne Wyoming courts have any occasion to enforce the Ed munds law and construe the cohabitation clause of that law they too will adopt the interpretation given by Judge Zane If His Honor is sustained in his view of the law by the higher courts it will be very much to his credit It is likely that the question will not go to the Supreme Court of the United States although there is some question whether it is appealable to that tribunal or not If there is any doubt on this question it is to be hoped that an appeal will be granted if asked to the Supreme Court Washington It would be far more satisfactory to the i community at large to have the question passed on there although Judge Zane has the confidence of the community in his rulings generally lie has had the honorable distinction of a large judicial following although some of that following follow-ing had an opportunity to put their own construction upon that particular clause before Judge Zane ever came to Utah So far he has been sustained in his rulings by l the higher courts to which appeals have been taken There are other important im-portant matters to be passed upon here matters which have no connection whatever what-ever with the political phase of the laws but which are just as important We recently saw the need m a suuiiu lawyer in the now notorious Hopt case It was a case in which the whole Territory felt outraged for a man had been most foully murdered and all the evidence pointed to the guilt of one man and that man was Hopt who was convicted three times of murder in the first degree and sentenced to be executed and who three times took his appeal to the Supreme Court of the United States and three times was that case sent back for a new trial It is generally gen-erally believed through the community that if Judge Zane shall try this case on its fourth trial that it will not be sent back for a fifth one If he shall succeed in making his view of the law in this case also succeed and be affirmed by the court of last resort this will also be to his credit and for once he will unite all parties in Utah in his praiso |
