Show = A TEXAS DEATH SENTENCE Verdict Still Good Tim Was Kcu ficrcd I any Years Ago J WACO Texas May 2JIn the winter of 18GO Charles Warren a farmer shot and killed Burton in Waco It was in the stormy period preceding the civil war and the trouble grew out of an argument respecting re-specting the right of a State lo secede Warren took the Southern and Burton the Union side of the argument Warren was tried in the district court of this county The evidence against him must have been strong for despite > his southern proclivities the jury found him guilty and fixed the penalty at death His counsel took an ap peal to the Supreme Court of the State and pending its consideration Warren was taken for safe keeping to the Freestone county jail in February 1851 Warren had a young daughter Rebecca Soon after his removal to the Fairfield jail Rebecca weut to Fairfield Without revealing re-vealing her nameoriGlAtionship to Warren she sought the jailer pleading poverty and inendlessness and obtained employmeut vn his family ns a domestic She afterwards stole the keys of the jail from the jailers pocket one night and released her father Yarren enlisted in u Texas regiment and served the four years of the war as a Con federate soldier When the strife ended he went to western Texas and settled down to farming His wife died and he married again The supreme court when news was received of his escape from jail dismissed the appeal and the case had passed out of mind here Of the jury that convicted Warren War-ren probably all are dead Tho judge however N W Battle is still living here and so are two of the states witnerses who testified against Warren By some means Van Hall the htfad of Halls detective agency here heard that Warren was living in Lampasas county Hall procured the requisite papers went to Lam asau yesterday and arrested Wanen He was brought to Waco today and placed in jail He is now M l years old gray and decrepit de-crepit The old man broke down and wept when the jail door closed on him He says he is poor and hardly knows what to do The case has excited much interest and many persons have visited Warren in jail Lawyers say that unless the governor intervenes inter-venes the district judge here will be compelled com-pelled to order the sheriff to carry out the sentence pronounced againit Warren twenty four years ago Leading citizens will appeal to the Governor to either pardon Varren or commute the sentence The daughter who released her father a quarter of a century ago is still living in this county a staid matron with grown children I |
