COUNCIL OF CITY or OF ROOSEVELT ROOSEVE 3 VE LT UTAH section 1 that there are hereby enacted certain sections to be known kno wil as sections 11 1 to 53 both inclusive la in relation to special taxes which shall read as follows to section 2 powers ot of council when the city council shall deem it expedient to lay out establish open extend widen all any y street or alley improve repair ig grade rade pave curb and gutter sewer drain park or beautify the same or to establish grades construct bridges sidewalks cross walks driveways from the curb to property line lighting equipment sewers and drains plant or cause to be planted cultivated and maintained lawns grass and shade bade trees in the parking spaces therein pr or to maintain replace or renew any ot of such improvements they shall first personally inspect such proposed improvement and th the e same or any part thereof may be done in the manner provided in this chapter to deray the cost and expense ot of such improvements or any ot of them the city council may proceed after acquiring jurisdiction as provided by law to levy by erdl ordinance special taxes and assessments upon the blocks lots lota or any parts thereof and pieces of ground fronting or abating upon or adjacent to the street or alley thus in whole or in part opened widened or improved or which may be effected or specially benefited by any of such improvements to the full depth of such lots parts of 0 lots lota or pieces of ground provided that where any lot or piece ot of ground is of a greater depth than feet back from the street such assessment shall be levied upon such lots or pieces of ground to a depth ol of teet feet only provided further that in case of assessment for sewer improvement 60 feet frontage of any corner lot abutting upon two or inore more streets shall be exempt from assessment where the sewer Is constructed along more than one side of such lot section 3 notice of intention in all cases before making any of the improvements or levying ot any taxes for any local or special improvements the city council shall give notice of intention to make such guch improvements and to levy such tax which notice shall state the purpose for which taxes are to be levied the boundaries ot of the district dittri ct to be effected or ben emitted by the improvements and in a general way describe the improvements proposed to be made with the estimate cost as aa determined by the and may designate one or several different kinds of service or of material or forms of construction such notice shall be published for a period of at least twenty days in each issue of 0 a newspaper published within the city such notice shall designate a time within which protests shall be tiled filed with the city reco ider each person person who la is owner of prop airty to be assessed in the mentioned in the notice shall have the right to tile file in writing a protest pio against making such improvement it if at any before the time fixed in such notice written objections to the making of such improvements prove ments and the levy of at such tax signed by the owners of two thirds of the front feet or in case the assessment be by square feet then two thirds of the square feet located by lots lota ar or blocks of the property froli fronting ting or abutting abutting g on or adjacent to the streets or public alleys to be improved or especially affected or berie fitted thereby be tiled filed with the city recorder ne corder then such buch propped prop oyed improvements shall not be ordered made if the owners of two thirds of the property mentioned do not tile file such objections then the city council shall have jurisdiction to order the malting making ot of the improvements mentioned in said notice such notice shall be substantially in the following form NOTICE OF INTENTION notice is hereby given by the city council of city of roosevelt utah of the intention of such city council to make profiles and specifications on tile file in the office of the city engineer EngIn cei and defray the abutters portion ot of the cost coat and expense thereof by special assessment S ses Pew ment upon also give estimate of the total cost of improvement and cost per front foot or square toot foot all protests or objections to improvements or to carrying out of such intention must be in writing signed by the owners of the prop drop erty affected or describing tho the same together with the number ot of float dont feet or square feet and ail before the day of 19 the city council at its first the city recorder and tile the city treasurer a list of the owners of the property within the district affected by such improvement and the recorder shall within five days thereafter mall mail post paid to each of said property owners a copy ot of said notice ad dr dressed to the last known residence of such property owner the city engineer shall when directed direct edi so to do by the city with the making of 0 such improvements it shall make an order which shall h all be entered of record upon the minutes of its proceedings edinga authorizing and directing the work to be done I 1 and the improvements made anade section 6 5 NOTICE TO contractors before any special tax for special improvement shall be levied the city council shall cause to bo be published a notice to contractors calling for bids for the mahln making g of the improvements described in the notice of intention said notice shall be published for a period ot of at least twenty days in each isue of a newspaper published in city of roosevelt said notice may bw be published concurrently with publication of notice of intention where the assessment is to bp be levied for the cost of opening widening or extending streets or alleys the purchase or condemnation price of 0 the land shall be deemed the contract price and notice to contract contractors ora shall be dispensed with SECTION 6 improvements INCLUDED the city council may include in any contract for work in any district any one or more ol of the improvements specified in section 4 ot of these ordinances and where an any y improvement in any extension varies a as to character width width extent or otherwise ze the city council may assess the property fronting abutting upon or adjacent to the street improved at varying rates in accordance with the character width or extent of the improvement upon that portion ot of the street immediately abutting or adjacent to said property SECTION 7 LETTING OF CONTRACT the contract for the making of such improvements shall be duly let by the city council to the lowest responsible bidder tor for the kind of service or material or form of construction which may be determined ter mined upon by the city council atter after the opening of bids tile the city council shall have the right to reject any or all bids SECTION 8 INTERIM WARRANTS the city council may from time to time as the work proceeds in any improvement district pursuant pursuant to contract duly entered into issue to the contractor interim warrants against the improvement pro district tor for not to exceed ninety per cent in value of 0 the work theretofore done as evi dance by the estimates of the city engineer such warrants shall bear interest at the rate of six per cent per annum from the date of issue e until fifteen days after the levy of assessment said interim warrants and the interest thereon shall bo be taken up and paid by the special improvement warrants or special improvement bonds issued upon levy of assessment asse atter after completion of the e work SECTION r SECTION 9 BOARD or OP equalization whenever the city engineer shall issue iss 1 ue a certificate covering 91 a portion or all of the work completed in any improvement district district he shall file a copy of the with the city council and said council shall thereupon appoint a board of equalization and review to consist of three or more ot of its members which board shall upon the completion of the costs ot of the property within the district give public notice of the completion of such lists which notice shall be published at least one day in a I 1 newspaper printed in the city anil and shall contain the date on which said board boball bogia begin its sittings which date shall be at least five days from the date ot of publishing such notice such notice bhail state the time and place of meeting of said bald board which shall be during the usual business hours and I 1 for not less than three consecutive days and during the time specified said list shall hall be open to public int sn spec tion and any person feeling aggrieved shall have a hearing land said bald board shall have dave authority to make corrections in hi any proposed assessment and after said board shall have met for at i least three days it shall make a report to the city council of any changes or corrections ions made by it in III the assessment list and upon such buch report being made to it the city council shall proceed with the levy af pf of such tax SECTION 10 ENGINEERS RS certificate whenever the city engineer shall issue a certificate covering a portion or alt all of the work completed in ciny any improvement district he shall transmit a copy of I 1 said certificate toge together ther with a plat of the tha prop property eity affronted to the city treasurer and immediately immediate ly 1 upon receipt of said copy hod and plat the city treasurer shall cause to be made an accurate list of the property affected and immediately immediate ly upon the completion of said assess ment ment meni list the Tria treasurer surer shall tile file a true copy thereof with th the e city recorder corder who shall thereupon notify the board of equalization and review that tho the assessment list has been completed and a copy thereof tiled filed in his office SECTION 11 LEVY af OF TAX when hen the contractor has finished the work contracted for or such part thereof as may be provided tor for in the contract or when lighting service or park maintenance is commenced after contract duly let or after purchase or condemnation price has been fixed for land acquired tor for the opening widening or extending of any street or alley the city council shall pass an ordinance levying a special tax sufficient in III amount to cover the cost of such improvements as appeals by the contract entered into for the performance of said work or the purchase or condemnation price pric 4 plus an amount not to exceed to 10 per cent tor for engineering and other expenses upon the blocks lots or parts darts thereof or pieces of ground in front of or along or upon which saw sam improvement has been completed according to due SECTION 12 SPECIAL TAX assessments HOW MADE the assessment of special taxes for improvement pro Dro purposes ahall be made as follows the total cost of the improvement interest on interim warrants it if any the contract price plus an amount not to exceed ton per der cent thereof to cover actual cost of engI engineering inspecting publishing notices and making the levy shall be levied at ono one time upon the property and unless otherwise provided in the tha ordinance of levy sh shall a il become delinquent lin quent as follows for paying ten equal yearly installments with interest on the whole sum unpaid at the rate of not to exceed seven per cent per annum annual payable at the time eacia installment is ia due to wit one tenth thereof one year after the ordinance levying the tax for tle the payment of the improvement becomes effective one tenth thereof in two bearo after such ordinance becomes effective one tenth thereof in three years arter such ordinances becomes effective one tenth thereof in four years after such ordinance becomes effective one tenth thereof in five years alter after such ordinance becomes effective one tenth thereof in six years after such ordinance
