Show careless users of water along highway may be prosecuted the state road commission lias bae notified the road inspectors of du and uintah counties that unless the landowners along t the e state roads are more careful ot of their waste water in ia the future than they have been action will bo be brought against them the following bulletin no 10 sent out by the chief engineer Is self explanatory and should be carefully read by every person in the basin who lives near the state highway subject liability of careless users of irrigation water complaints are frequently received at the office of the state road commission to the effect that property owners or renters along the state highways are permitting irrigation water to flow upon the road to anyone using the roads it Is evident that such practice results in a real danger to traffic ae and an injury to the pavement or other form of Bur surfacing facing the state has relieved the counties of the burden or maintaining the state roads and is particularly interested in seeing that no funds are expended in highway repair that is necessitated through the negligence of those citizens who permit irrigation or surface water to flow from their premises and upon the state highways it is highly essential that every dollar of 0 the limited funds available be carefully conserved and as ag tax payers those morse citizens should take due notice that pe careless use of water causes each year the needless expenditure of public funds section 2840 compiled laws of utah 1917 makes those responsible tor for phlp the flooding of highways with irrigation water guilty of a misdemeanor and a tine fine or imprisonment or both follows conviction vic tion the section cited roads in part as follows any kerpon who wilfully ar carelessly obstructs or injures any ny public or other highway by causing or permitting flow of seepage of water or who wilfully or carelessly permits water under his control to escape in any manner so as to injure any public or other highway shall be deemed guilty of a misdemeanor the state highway engineers and patrolmen are instructed to protect I 1 the highways from this nuisance and where necessary to report the violation of the law to the authorities P F H KERR chief engineer dated may 1927 at salt lake city utah |
