Show utah water statute booklet published A booklet containing a compilation of all utah statues relating to water and irrigation has been compiled by state engineer T H humpherys and was ready monday for distribution the booklet makes accessible to laymen as well as to engineers and lawyers the extensive ea amendments to existing water laws enacted by the 1935 1937 2937 and 1939 legislatures and constitutes the most nearly completed compilation kofl 0 f utah water laws available some of the most important changes in the water laws made since the 1933 revision of the stat utes and revealed in the compilation are given by mr humpherys as follows I 1 all underground water is declared to be the property of the th e public subject to existing rights to the use thereof 2 the state engineer is charged with the duty of administering underground waters as well as surface waters 3 all well owners are now required to file statements of claims to underground waters to avoid presumption of abandonment 4 extensions of the five year period of nonuse of water may now be granted bv the state elig engineer ineer 5 statutory procedure for a chancre of point of diversion place and purpose of use me is declared to be exclusive 6 well drillers drillars dr illers must obtain permits from the state ebig engineer incer 7 provisions have been added to prevent the acquis uon of water vater rights by adverse use or adverse possession 8 the state engineer is autho auchoi izod to consider the physical and economical feasibility of proposed projects for the use of water 9 reservoir or dam owners are required to report to the state engineer the names locations and capaci capacities capacity tf s of reservoirs as well as height of dam |
