| Show SENTENCE IS SUSPEND 0 by JUDGE N J BATES county officials surprised by courts action after second conviction convicted twice by jury within two years of violating the liquor laws paul beutler was let off last monday by district judge N J dates bates with a suspended sentence much to the surprise of county officials who had obtained the conviction last year beutler was char charged with bootlegging before justice S G dark clark of richfield but the defendant obtained a change of venue to the annabella court nh where ere a jury jury found him guilty and the judge imposed a 1 fine of the case was appealed to the district court where a jury sustained the conviction but judge bates reduced the fine to in september of this year beutler was again arrested by sheriff nr al fairbanks on a warrant sworn to by federal officers who claimed t to 0 have purchased a bottle of moonshine from beutler he was convicted by a jury of persistent violation and since e that time his attorneys have succeeded aeed ed in obtaining delay after delay through motion for new trial and other devices on monday of this week judge bates overruled the motion for a new trial and proceeded to impose a sentence of not less than three months nor more than two years in the state penitentiary the court then unexpectedly suspended bus this sentence with the comment that knowing the defendant and his family as he did he did n not ot consider him the type of man to be sent to the penitentiary tent iary the defendant was warned by the court however that if he continued to do as he had been doing he would again be taken up by the officers of the law in the last weeks reaper the statement was made that joseph R christensen of monroe was sentenced to jail until his fine was paid this was slightly erroneous since since christensen was fined e d 50 and given two months and two weeks to pay the fine or else go to jail |
