Every indication is that a special grand jury will be called to inquire into the matter of a coal com- bination in Salt Lake and other mat- j ters in which there is every-.reason to ! believe that a combination in restraint i of trade exists. i There was a conference held in j the governor's office late Monday nf- j ternoon, at which were present Gov- ernor Charles R. Mabey, Attorney General Harvey IT. Cluff, District Attorney At-torney E. A. Rogers, and County Attorney At-torney Authur Moreton, when general gen-eral conditions were discussed. No definite conclusion was reached, but the general trend of the discussion was for the calling of a special grand jury. At the time that the national guard was called out and sent to Carbon county for the protection of the lives j and property of the people, it was understood un-derstood that in the mines which would than be enabled to run that when the strike was settled there would be no increase in the price of coal to the public. , The method of calling a special grand jury rests with the district judges. Recommendation or motion is made by the district attorney to the judges that he has evidence enough to show that there is a violation of the statutes that can only be reached through a grand jury, and it is then up to them to make the order. The attorney general, in his letter to the governor on September 9, said that "from what you say and from other reports I have heard I believe a grand jury investigation is necessary, neces-sary, and I am convinced that the machinery provided by our present laws is ample to handle the situation." situa-tion." Then he cites the statutes, which provide that "any combination by persons having for its object or effect the control of prices of any professional services, any products of the soil, article of manufacture or commerce, or the cost of exchange or transportation, is prohibited and declared unlawful ;" also that "any person or association of persons who shall enter into, become a member of, ar a party to, any pool, trust, agreement, agree-ment, combination, confederation or understanding with any other person ar persons to fix or regulate the price af any article of merchandise or commodity, com-modity, become a party to any pool ar trust or agreement to fix or limit the amount or quantity to he mined or sold shall be deemed guilty of a conspiracy to defraud and subject to nunishment." This punishment provides pro-vides fines ranging from l?100 to f20OO for the first, offense ar '. up to f 15,000 for subsequent offenses. This recommendation and citation of the statutes by the attorney general gen-eral may be followed out and a grand jury investigation requested. |
