Show ORDINANCE NO. 1959-3 AN ORDINANCE REPEALING CHAPTER XIV OF THE REVISED RE-VISED ORDINANCES OF PLEASANT GROVE CITY, 1950, AND PROVIDING FOR THE ENACTMENT OF THE FOLLOWING SECTIONS WHICH WILL BE ENTITLED EN-TITLED CHAPTER XIV, SECTIONS 192, 193, 194, 195, 196, 197, 198, 200, 201, 202, 203, 204, 205, 206, AND 207, RELATING TO DOGS. BE IT ORDAINED BY THE CITY COUNCIL OF PLEASANT GROVE CITY: Article I Sections 192, 193, 194, 195, 196, 197, 198, 199, 200, 201, 202, 203, and 204 of Chapter XIV of the Revised Ordinances of Pleasant Grove City, 1950, are hereby repealed. Article 1 1 The following sections to be entitled Chapter XIV of the Revised Ordinances of Pleasant Grove City are enacted en-acted as follows: Section 192 Dog Tax Collector The Mayor, by and with the consent of the City Council, may appoint some suitable and competent person to the office of dog tax collector, who shall qualify in the manner provided by law and shall hold such office for such term, and shall receive such compensation compensa-tion as may be determined bythe City Council. Section 193 Annual Registration Fee It shall be unlawful for any person to own, keep, or harbor a dog within the limits of Pleasant Grove City without making application to the dog tax collector for that purpose, and paying to Pleasant Grove City an annual registration fee of $8.00 for a female dog and $4.00 for a male dog- The annual registration fee for a spayed female dog shall be the same as for a male dog. This section shall apply to any dog other than suckling pups. Section 194 Registration Certificate It .shall be the duty of the dog tax collector to register any dog on application of the owner or keeper and to issue a 'registration receipt and metallic registration tag on payment by the owner or keeper to the City of the annual registration fee. The name of the owner or keeper, together with a description of the dog shall be filed with the City Recorder. Section 1 95 Owners to provide Collars It shall be the duty of the owner or keeper of any dog so registered to provide a suitable collar for such dog to wear and to attach thereto the metallic registration tag. Any dog not so registered and collared as therein provided shall be liable to be killed by the Dog Tax Collector" or the Police. Section 196 Dogs Running at Large It shall be unlawful for the owner or keeper of any dog, whether registered or not, to permit said dog to run at large at any time within the limits of Pleasant Grove City off the premises of the owner or keeper. keep-er. A dog off the premises of the owner or keeper must be on a v leash accompanied by a responsible person at all times when within the limits of Pleasant Grove City except when used for hunting purposes during the days designated as official game bird hunting season. Section 197 Duty of Police Officers It shall be the duty of all Pleasant Grove police officers to kill and destroy, or cause to be killed and destroyed, any dog, whether registered or not, found running at large at any time within the limits of Pleasant Grove City off the premises of the owner or keeper, keep-er, when, in the judgment of such officer, it is necessary to kill such dog in order to maintain or protect the health, safe- -ty, peace or property of the inhabitants of Pleasant Grove City. Section 198 Impounding Dogs Any dog owned, kept or harbored within the limits of Pleasant Grove City which is not properly registered and collared as required in this chapter, may be taken up-and impounded by any Pleasant Grove police officer wherever such dog may be found; and any dog found running at large at any time within the limits of Pleasant Grove City off the premises of the owner or keeper, may be apprehended and impounded by any person who shall immediately im-mediately deliver such dog to the Pleasant Groye City pound. If such dog is properly collared and registered as herein prescribed, pre-scribed, notice shall be given in person or by mail to the owner or keeper at the address stated on the copy of the registration registra-tion receipt retained by the city recorder, and the owner or keeper shall have five days after personal notice or after mail-' mail-' ing of notice to redeem the said dog as hereinafter provided. Written or oral notice given to the owner or keeper or to any member of his or her household over the age of fourteen four-teen years shall be construed as personal notice, and notices by mail shall be accomplished by depositing such notice in the mail, -at the post office in Pleasant Grove, Utah, addressed as above stated, postage prepaid. . Section 199 Redemption of Dogs Any dog impounded in the Pleasant Grove City pound may be redeemed by the owner or keeper, unless such dog has already been destroyed, by paying to the city recorder a pound fee of $5.00, plus $1 .00 for each day the dog has been impounded; however, the payment pay-ment of .such fee shall not exempt the owner or keeper from prosecution or punishment for the violation of this chapter as provided in Section 207. Section 200 Destruction of Impounded Dogs Any dog not properly collared and registered as required by this chapter may be destroyed after it has been impounded five days without with-out being redeemed, and any dog which is properly collared and registered may be destroyed after the expiration of five days notice to the owner or keeper as provided in Section 198 in the event such doa is not redeemed. Section 201 Fierce or Dangerous Dogs It shall be unlawful for any person to harbor, keep, own or possess a rabid, fierce, dangerous, vicious or mischievous dog within the limits of Pleasant Grove City. Section 202 Dog Which Disturbs the Peace It shall be unlawful for any person to harbor, keep or own within the limits of Pleasant Grove City any dog which by barking, howling howl-ing or yelping disturbs the peace and quiet of any neighborhood, neighbor-hood, person or persons. Section 203 Abandoning Dogs Within City Limits It shall be unlawful for any person to abandon any dog or turn the same out at large within the limits of Pleasant Grove City. Section 204 Cruelty Prohibited It shall be unlawful for any person to maltreat or torture any dog or, having the right to kill any dog, to kill it except in a humane manner. Section 205 Removal of Collar or Registration Tag It shall be unlawful for any person other than the owner to remove re-move the collar from any dog to which collar has been attached attach-ed the metallic registration tag herein required, or to remove said metallic registration tag from the collar to which it has been attached. Section 206 Application to Non-Residents Nothing in this chapter shall be so construed as to affect persons not residing in this city who may temporarily visit this city and own a dog; provided that such person shall constantly keep such dog under his or her personal care and not allow the same to run at large. Section 207 Penalty Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punished by a fine in any sum, not exceeding one hundred dollars ($100.00) or by imprisonment for a period of no longer than three months or by both fine and imprisonment. Article 1 1 1 All ordinances or parts of ordinances in conflict con-flict with the provisions of this ordinance are hereby repealed. Article IV If any one or more sections, sentences, clauses, or parts of this ordinance shall, for any reason, be questioned or held invalid, such judgment shall not affect, impair or invalidate the remaining provisions of this ordinance, ordi-nance, but shall be confined in its operation to the specific sections, sentences, clauses or parts of this ordinance so held unconstitutional and invalid, and the inapplicability and invalidity in-validity of any section, sentence, clause or part of this ordi nance, in any one or more instances, shall not affect or prejudice in any way the applicability and validity of this ordinance in any other instances.
