Show Septic tank ordinance outlined for Pleasant Grove for the installation and extension of the Pleasant Grove City Sewer System at such time as said sewer system shall be extended ex-tended to service the structure or development develop-ment for which the building permit or plat approval is sought. 2. Each such individual in-dividual or entity shall agree on behalf of himself, his successors, and assigns to connect to the Pleasant Grove City sewer system, at such time as said City sewer system is made available. 3. Each such individual in-dividual or entity shall agree on behalf of himself, his successors and assigns to install and shall install out to such individual or entities property line, at the time of original construction, full and complete lateral lines, collector lines, valves, connectors, and all other necessary mafarialc' pftncictant subdivision plat approval ap-proval be required to execute a document releasing Pleasant Grove City from any and all loss or damage resulting directly or indirectly from the construction or use of any individual wastewater disposal system located upon or servicing such individual in-dividual or entity's property and shall further execute a document wherein such person or entity agrees to hold harmless and indemnify Pleasant Grove City against any and all losses, liabilities, and claims from any and all losses or damages resulting directly or indirectly from the construction or use of said individual wastewater disposal system. SECTION C. REQUIREMENTS FOR INDIVIDUAL WASTEWATER DISPOSAL DIS-POSAL SYSTEMS. Pleasant Grove City hereby adopts the "Regulations for Individual In-dividual Wastewater Disposal Systems," as adopted by the Utah Department of Health on February 5, 1984, and revised by the Utah Department of Health on May 21, 1984, attached at-tached hereto and incorporated in-corporated herein by reference as fully as if re-written herein, as the Pleasant Grove City requirements for individual in-dividual wastewater disposal systems, hereby amending Title 9, Chapter 4, of the City Code of Pleasant Grove, Utah arid all other ordinances inconsistent with the provisions of this ordinance, with the following exceptions and modifications to said "Regulations for Individual Wastewater Disposal Systems." 1. All references in said regulations to the State of Utah shall be deemed to refer to the City of Pleasant Grove. 2. All references in said regulations to the "Utah Department of Health," "Health Authority," "Department," "Depart-ment," and "Local Health Department," shall be deemed as references to the "Community Development Develop-ment Director." 3. Section 3.2.1. of said regulations shall be and is hereby changed to read: In areas where absorption systems ' are to be constructed, the maximum elevation of the seasonal ground water table, or perched water table shall be at ' least four feet below the bottom of the absorption ab-sorption system and at least six feet below finished grade. The four feet of separation herein required cannot be obtained by the importation of material. The community com-munity development director may impose stricter separation requirements between absorption systems and the maximum ground water table when deemed necessary. 4. Section 3.2.4 of said regulations shall be and is hereby changed to read: A curtain drain or other ground water interception cannot be used to obtain the four feet of ground water separation required in Section 3.2.1. 5. Sections 2.2. and 2.10 of said regulations are hereby deleted. SECTION D. CONFORMITY CON-FORMITY WITH STATE LAW. Any provision of this ordinance, including the provisions adopted or incorporated by reference, which are found to not meet the minimum requirements for individual wastewater disposal systems, or the minimum requirements of any other applicable State law are hereby deemed changed to conform with any such law. SECTION E. AMENDMENT OF CONFLICTING ORDINANCES. OR-DINANCES. The provisions of all other ordinances in conflict 'with this or dinance are hereby amended to conform to the provisions of this ordinance. SECTION F. LIABILITY FOR LOSS OR DAMAGE. Pleasant Grove City hereby discliams any and all liability for any and all loss or damage resulting in any manner whatsoever from the construction or use of an individual wastewater disposal system, notwithstanding not-withstanding compliance com-pliance with the requirements of this or any other Pleasant Grove City Ordinance or standards, and hereby gives public notice that all responsibility and liability in anyway resulting directly or indirectly from the construction or use of an individual wastewater disposal system lies solely with the individual or entity constructing or using said system. SECTION G. PENALTIES. Any person violating any of the provisions of this ordinance shall be deemed guilty of a Class "B" misdemeanor, and upon conviction thereof, shall be punished by a fine in an amount less than $299.00 or imprisonment for a period of not more than six months, or by both such fine and imprisonment. SECTION H. SEVERABILITY. The provisions of this Ordinance and the provisions incorporated herein by reference are severable and any decision declaring any portion of this ordinance or-dinance to be invalid shall not affect the validity of the remainder of this Ordinance. In the opinion of the City Council of Pleasant Grove City, it is necessary for the preservation of the peace, welfare, heal and safety of Hi inhabitants of Pleasait Grove City that this ordinance take effect immediately upon lis passage and firsi publication as provided by law for the reason that an emergency exists in that Hi maintenance of Iki health, safety and welfare of the Pleasant Grove residents is dependent upon 11k enactment of this ordinance. or-dinance. J city PlSsaK July 18, l?84' AN ORDINANCE STATING PLEASANT GROVE CITY POLICY AS TO INDIVIDUAL WASTEWATER DISPOSAL DIS-POSAL SYSTEMS AND IMPOSING CERTAIN REQUIREMENTS FOR SEWER SYSTEMS AND INDIVIDUAL IN-DIVIDUAL WASTEWATER WASTE-WATER DISPOSAL SYSTEMS TO BE CODIFIED AS TITLE 9, CHAPTER 4, SECTION SEC-TION 10, OF THE CITY CODE OF PLEASANT GROVE, UTAH. BE IT ORDAINED BY THE PLEASANT GROVE CITY COUNCIL: SECTION A. STATEMENT OF POLICY. It is the policy of Pleasant Grove City that the entire City be serviced by and connected con-nected to the Pleasant Grove City sewer system. Therefore, all individual wastewater disposal systems hereafter installed, or approved for installation in-stallation within Pleasant Grove City shall be installed and approved on a conditional con-ditional use basis only. Said conditional use shall be withdrawn and become void at such time as the Pleasant Grove City sewer system is made available to provide sewer service. SECTION B. SEWER SYSTEM REQUIREMENTS: REQUIRE-MENTS: Title 7, Chapter 14, and Title 9, Chapter 4, of the City Code of Pleasant Grove City, and all other ordinances inconsistent with the provisions of this ordinance or-dinance are hereby amended to require that each individual or entity requesting a building permit or acceptance by Pleasant Grove City of a subdivision sub-division plat in which any building or subdivision sub-division is proposed to be serviced by an individual in-dividual wastewater disposal system, shall, prior to the granting ol any building permits and prior to the acceptance ac-ceptance and approval of any subdivision plal by Pleasant Grove City, comply with and agree to the following conditions: con-ditions: 1. Each such individual in-dividual or entity shall agree on behalf of himself, his successors, and assigns to pay his pro rata share of costs with Pleasant Grove City standards to connect to the Pleasant Grove City sewer system at such time as said system is extended to provide sewer service ser-vice to such individual or entities property, including, but not limited to, all materials necessary to minimize future construction costs due to asphalt removal and replacement. Compliance Com-pliance with this section shall require that all structures or subdivisions sub-divisions not connected to the Pleasant Grove City sewer system at the time of original construction be provided, at the time of original construction, with a dual sewer system consisting of a complete private temporary sewer system and a complete sewer system out to such individual or entities property line consistent with Pleasant Grove City , standards for future '. permanent connection i to the Pleasant Grove City sewer system.
