The yet unsettled right of way fight between Dan Wil-lard Wil-lard and Park City Municipal Corp., resurfaced again this week during the Planning Commission's working session. ses-sion. The dispute arose when Dan Willard approached the Commission for a conditional condition-al use permit to conduct regular reg-ular "Flea Markets" or "Swap Meets" this summer on two vacant lots he owns on Main Street. Although the Commission recognized the proposedflea market could be an asset to the town, the request was denied on the advice of City Attorney Carl Nemelka. The City Attorney maintained main-tained that they couldn't grant the conditional use permit until the matter of the alleged city right of way through the two lots is settled. The City maintains that through usage they have a driving right of way through Willard's property. Willard maintains they do not. Willard Wil-lard is however willing to grant the City a pedestrian right-of-way but will not concede to a dedicated street through his property. City Recorder, Bruce Decker seems to think the City is not interested in a driving right-of-way and would be happy to accept a pedestrian walk way as long as it is legally dedicated to the City for time immemorial. immemor-ial. Dan Willard has extensive plans to build a shopping arcade ar-cade on the site and is reluctant reluc-tant to dedicate the right-of-way in any particular spot until his plans become more concrete. , ' Willard indicated that he would dedicate to the' City a walking right-of-way through his property, if the exact location could be arranged at a latter date when Mr. Willard's building plans for the site become finalized. Meanwhile the entrance to controversial Willard Boulevard Boul-evard is blocked by a swing set that is constantly occupied oc-cupied by Park City children making adrivingtrip through the site a rather unappetizing unappetiz-ing alternative. |
