Driveways will be installed as a part of the improvements only at the option and request of the property owner, made in writing to the City Recorder Record-er before construction of such improvements is commenced. If so requested and installed, the cost will be assessed against the property benefited, in addition ad-dition to the assessment for other improvements. There shall be an allowance for corner lots to be apportioned appor-tioned as provided for by law. All non-conforming improvements improve-ments such as lawns, sprinkler systems, rock gardens, driveways, drive-ways, curbs, gutters, culverts, walks, fences, etc. which have jbeen built or installed by abutting abut-ting property owners within the areas to be improved, must be -removed by the property owner at their expense, prior to the commencement of the project. If these non-conforming things are not removed by the property prop-erty owners, they will be removed re-moved by the contractor and disposed of by him as directed direct-ed by the city engineer. PROTEST Any person who is the owner of property to be assessed in the special improvement district dis-trict described in the Notice of Intention shall have the right to file in writing a protest to the creation of the special improvement im-provement district or to make any other objections relating thereto. Protests shall describe des-cribe or otherwise identify the property owned by the person or persons making the protest. Protests shall be filed with the City Recorder of Park City, Utah on or before 5:00 o'clock p.m. on April 18, 1973. NOTICE IS HEREBY GIVEN by the City Council of Park City, Utah, of its intention to make the hereinafter descrilied improvements within said special spec-ial improvement district and a further intention of said council coun-cil to levy special taxes or assessments as provided in Title 10, Chapter 16, Utah Code Annotated, 1953, as amended, on the property lying within said district for the benefit of which such special taxes or assessments assess-ments are to be expended in the making of such improvements. improve-ments. The purposes for which the special taxes or assessments are to be levied are to construct storm drains; roll gutters and drain; base and bituminous road surfacing; replace existing 6 in. sewer main with 8 in. sewer main and new laterals; replace existing 4 in,water main with 6 in. main and new service lines; install meters at existing services; ser-vices; grading; to purchase, condemn or otherwise acquire any property in order to make such improvements; and to do other miscellaneous work necessary to complete the improvements im-provements in a proper and workmanlike manner. It is proposed to levy assessments assess-ments on the property within the district to pay all of the costs of the improvements according to the benefits to be derived by such property. The method under which the assessments are proposed to be levied to defray the abutter's portion of the cost and the expense of said improvements is by a special tax or assessment to be levied according to the front or linear foot frontage upon and against all lots, pieces, or parcels cf land to be benefited and affected affect-ed by said improvements. The whole or any part of the assessments assess-ments may be paid without interest within fifteen (15) days after the ordinance levying the assessment becomes effective. If the assessment is paid in part, the unpaid balance shall be payable in substantially equal installments over a period of ten (10) years with interest on the unpaid balance at a rate or rates not to exceed seven (7) per cent per annum until due and thereafter at not to exceed ex-ceed ten (10) percent per annum an-num until paid all as specified in the assessment ' ordinance.
