Show alfred moya held the case ol of alfred moya charged with feloniously making an assault upon a minor with intent to ravish to which I 1 he entered a plea ot of not guilty on september I 1 lath was heard before justice jim don yesterday to which an all visitors were denied and occupied two hours in I 1 hearing the testimony of the fifteen year I 1 old girl together with the denial of defendant fen dant who maintained his innocence of any wrong doing throughout the proceedings ce represented by attorney B R R hackett tor for the defendant and L F P anderson tor for the state county attorney in charge the straightforward story of the girl ot of tender years lett left alone in a home where she bho had been called to give attention to children while the mother some younger tended attended 8 t a church entertainment was convincing to the court that it was not a story etory made up from a youthful delusion nor from any me malice lice generated without facts or foundation lound atlon that might emanate from the flighty brain ot of one not yet having reached the height of womans comans comprehend compre comprehension hen r ion as to dangerous adventure apparently nothing was fabricated ric abed by tho the girl on the stand although the persistent dental denial on the pa part rt would suggest the possible of f defendant of a fragmentary were it told by one of more advanced years I 1 but all this was dispelled when nothing to what happened could shake the witness as court ordered him held per ed and the to pear appear in the district court under bond of it will be recalled caled re that this same defendant was dismissed september on a similar complaint filed by a lady because of sufficient evidence 1 ing lacking but at the close of the we ase heard yesterday and herein noted a third complaint of like order was heard which took up three hours in determining the disposition of same the story of this lady of unquestioned integrity clearly defining the action of moya on the night ot of september 3rd ard when he visited the home during the absence of her husband made known his purpose and later his demands followed by his repulsive approach and actions which continued until a forcible setback was directed at the invader after which he be made his exit to all of this moya entered a dental denial except as to being at the home on the night in question commenting on the evidence presented very much at variance one with the other the justice suggested that ns as some people are led to believe that the wrath of god will descend upon the person who deliberately falsifies after a having raised tile the uplifted hand in solemn oath to speak the truth then his presence should have come to the heart of one or the other who was beyond question lying and he further argued that no lady honored with the name of mother could or would deatle her honor by such a recital of facts if they were entirely untrue for the benefit of our readers and in fairness to the defendant and those whom it Is alleged were his intended victims no harm was accomplished such as was apparently anticipated defendant was ordered held to answer in the district court under 2000 bond failing to raise the total amount in the combined figures he was committed to the of sheriff dark clark |
