Show COUNCIL PUSSES independent TELEPHONE COMPANY AT LAST HAS AN ORDINANCE PASSED GRANTING IT A FRANCHISE IN restaurants 1 council passes a resolution definitely fixing work and authorizing pay for the sprinkling election and qualifying of councilman craig is endorsed at the opening of the council session I 1 last evening the recorder called attona tion to the fact that william craig the new councilman from the third was present and that he had filed his bonds and taken the oath of office and that the i bonds had been approved by the mayor I 1 councilman paine said that as there had been some question raised as to whether mr craigs election had been legal a majority of the council elected not having voted for hm he thought that it would be well to reconsider the action of the council and to reelect re elect mr craig by a unanimous vote councilman kandall thought that it would be just as well to make the elec tion unanimous and he moved to amend the motion by mainc and take a vote on the matter councilman said that this could not be done the time for that would have been before the vote was announced last week however he thought that there is no doubt that mr craig is legally elected and as the council is by law the j audgo 0 the election and qualification of its own members there can be no question on the matter i councilman nye read the law govern i ing the matter and said that he had obtained the opinion of the city attorney and the official had stated that the election is legal the recorder stated thai he had a corn muni cation from the mayor on this matter councilman paine objected ll 11 to alio communication being read he said that was what be was trying to head off he did not want the mayor to come in and tell them what to do every time the council happen to do something wrong the mayor sends in a com munica tion as thought the council docs not know enough to set itself right after some other discussion the communication muni cation of the mayor was read as follows to the president and olein ber ot the city council ogden attah gentlemen I 1 desiro to call to your attention that in the of mr craig as a councilman from the third ward only five votes wet cast in bis favor and the chair declared him electta elect td as councilman from th third ward while five was a majority of the councilmen present it is not a of the whole council and after a cose reading of tho decision of the supreme court in the case of chief of polin poli n sheets of aalf lake city I 1 it would be wise if your honorable body baue the election of mr craig by unanimous vote in order to prevent any and legal differences feren ces which I 1 fear all take place in the near unless the records will show that mr craig hasi received more than five votes I 1 wold suggest that your honorable body since you have all acquiesced in the ruling of the chair that mr craig was elected would go on record as having elected mr craig by a unanimous vote as is usually the custom when a haa received a mi bority of the present very respectfully fully submitted councilman hendershott moved that it be filed but immediately withdrew the motion as he said lie was out of order anyway and seconded a hw tion by councilman randall to the effect that it be the sense of the council that mr craig id a duly elected and qualified member of the body the motion was carried and the been submitted to the mayor authorizing any sprinkling to bo done I 1 have watched the minutes of the council very closely I 1 find on tho first communication which the mayor sent to tha city council two months ago the same was referred to the water committee with a request that alio recommendation of the sprinkling abc left to the water committee no further action has been taken on the matter and the committee has put lers to work without any authority of law whatever in the vr arious ious commini castioni the mayor hai sent council for some reason or another the communications have al been misconstrued certainly the mayor has his in the matter as to whether he sprinkling shall be done by contract or by day work but that is not the question which my various communications have presented for your attention I 1 desire that the men sprinkling the city at the present time shall be properly authorized and I 1 therefore ask four honorable body ta a resolution instructing the sprinkling co m cittee to put the men to work or ordering tin to put the men to work either to order H done by contract or by day work I 1 dont care which but I 1 insist upon some action being taken by tha council mayor i id error n regard to what has been donn about the prink ling the matter vaa referred to tha sprinkling committee and they reported on it the mayor had ant ina tou wanting the wor klane by contract and the committee had rey 1 ported adversely on it aad recommended that the work be done by the day me said the mayors communication was not founded ou facts councilman chamberg stated that there is nothing on the records to show that the sprinkling had ever been authorized zed done in this manner williams thought that there was and be said that the committee bad done its duty lie said that the records could be searched for years back and it could not be found where any mayor exacted such a resolution the mayor seems to have hobby on this and keeps agitating it if the mayor will send in a communication telling what he wants the committee will try to do something in conformity with it councilman nyo said that the only thing that had been done was the passing of a resolution introduced by councilman williams which provided that the sprinkling shall be done under the supervision 0 the councilmen from each ward but there is nothing definitely mentioned concerning the hours or the wages iio thought that this is what the mayor wants settled councilman thought that this is covered by an entirely different resolution the one providing that eight hours shall be a days work on all public works and that the pay of a man and a team for the eight hours shall be if the mayor approved that resolution then he had approved the way the sprinkling is being done now councilman williams corrected mr hendershot he said in hiring the men ho did not tell them how many hours they were to work but how much work they must do councilman craig said that BO far as he could see all the mayor wants is to have some authority established for doing tha sprinkling and he thought the council should pass such a resolution councilman powers objected as he said it had never been the custom to do so councilman introduced the following resolved that the committee has the sprinkling done by the day eight hours to constitute a day at per day councilman williams did not believe that this will work and if the resolution passed he thought it would knock out the system that the committee has now got to working smoothly lie said that the men must cover their beats no matter how long it takes them and if it took them over eight hours then un der this resolution they would ask for extra pay councilman then amended his resolution to read resolved that the committed docs the was then put and carried unanimously city engineer barker then introduced substitute for the ordinance establishing curbs and sidewalk in the residence part of the city and slated that the conditions prevailing needed an ordinance which can tei accommodated to each block the was adopted in place of the original ordinance councilman williams stated that he did not believe that the ordinance should be pushed through last evening lie eaid there might be some technicality in t that would cause the mayor to veto it the city engineer urged that some ordinance of that character should be passed at once after some discussion lie rules were suspended and the ordinance was passed the ordinance regulating restaurants prohibiting the sale of liquors in these places and the use of booths was also passed the ordinance granting the independent telephone company a franchise camo up on third reading and was passed as it has been previously told the nance is virtually the same as the ono granting a
