Show HUGHES WILL ASK TO BE rXCUSED Washington, Sept. 21, Charles K. Hughes, when he becomes a member of the supreme court of the United States next month, will ask to he excused ex-cused fio ml he hearing of one of the first cases that will conic before the tribunal brcause It concerns on-? of his own oftlcinl acts. The court will he asked to decide whether Mr. Hughes, as governor of New York, ac:ed within the law in granting a wairant for the surrender, as a fugitive of justice of Frank N. Ilofl'stot. a Pittsburg capitalist, to the state of Pennsylvania. Hoffstot. who was indicted on a charge of conspiracy conspir-acy to bribe members of the Pittsburg Pitts-burg city council to select certain banks as depositories of city funds, sought to he released from the arrest ordered by Governor Hughes in response re-sponse to a reoucst of the povernor j of Pennsylvania. The circuit court for the southern district of New York, refused to release him and Hoffstot appealed to tho United States supreme court. Notice has just been filed with the court that a motion on behalf of the city of Pittsburg to dismiss the appeal ap-peal will he presented October 10. The brief in support of this motion seeks to maintain that (Jovernor Hughes was warranted in finding as a fact that Hoffslol was a fugitive from justice. jus-tice. I |
