Attorneys for ihe defenso aro concentrating their efforts In an attempt at-tempt to refute the testimony of witnesses wit-nesses for tho state and to show that the woman died as a result of taking oil of 80ine or some other drug with an object Dr. A. A. Kerr, the physician called in to attend Mrs Vance on No v. 27, testified that In his opinion her death was duo to mercurial poisoning. Dr. Kerr said that ho was informed over the telephone on Nov. 2, that Mr. Vance waa seriously HI and that he sent down Borne medicine to relieve the distressing condition reported. In the evening he weni down to the Vance, home, he Bald, and found her vomiting, and complaining of severe pains. Ho said that she continued to get worse and that he sent the ambulance am-bulance for her on the following day and she was taken to St. Mark's hospital. hos-pital. Tho witness testified that she complained about the condition of her mouth at the hospital and that there-she there-she had a number of hemorrhages from tho mouth and gums and also complaintd cf pains. On examinatoon at the hospital he said that he found a large black and biue mark o-n the Inner part of tho right thigh, He gave It as his professional opinion that she came to her death from mercurial poisoning and that it was also evident that she had received bodily Injuries. Associated with tho sounsel for the defense as expert authority Is Dr. Albert Al-bert Hansen, and It Is evident that medical authorities havo been examined examin-ed at length with the view to discovering dis-covering symptoms for mercurial poisoning poi-soning dlffenent to those described by Dr. Kerr. On cross examination, A. J. Weber started to read from a well known medical authority on poisoning, asking tho w.tnesd If ho did not concede con-cede tho symptoms as given to be right. Court Interposes. "Yon can't do that," interposed Judge T. D. Lewis. "If the court permitted per-mitted that, it would not be six months until books would bo printed especially, some for the prosecution and somo for the defense." The court ruled that the attorney might frome his answers from tho book, but that he could not read tho subject matter to tho jury. According to this authority the most prominent of the symptoms of mercurial mer-curial poisoning were constriction of the throat, foaming at the mouth and bloody frothing, great thlr3t and votn King. Dr. Kerr said that he had not rnticed th first symptoms on Mrs. Vance. The witness was on the stand at 12:10 o'clock, when court adjourned until 2 o'clock. The formost of the morning's session ses-sion was taken up in reading Into tho record the testimony of Mrs. Cora A. Rehpennlg, a neighbor of the Vances at the time of the alleped nsxuall. The transcript of the testimony taken for the former trial was reported by the morning papers ns being a missing exhibit, ex-hibit, that It had mysteriously disappeared, disap-peared, but its disappearance was easily traced to tho clerk's ofTlce, where it was found. Transcript Read. Mrs. Rehpennlg left the state shortly short-ly after the preliminary examination and It was necessary to use tnls transcript at the first trial. Mrs. Rehpennlg says, she heard some trouble between the Van-ces Van-ces over a cup of coffee, and that thc following quarrel she hard an awful thud and tho children scream. She further testifk-d that Mrs. Vanco came to the back door and called call-ed to Mrs. Wunderllch: "Will you please 'phone for an oftlcer. he is trying try-ing to kill me." Mrs Wunderllch, di dares the witness said; "Who Is trying try-ing to kill you?" "Tom Vance, the brute I call my husband." replied Mrs. Vance The witness affirms that afler Vance went to work she went Into the Vance home and there found Mrs. Vance sobb'ng and crying, with coffee spilled all over her clothes. She suld that she then notofled the doctor. On the 2Sth she says Mrs Vanco was taken to the hospital. She say a that she noticed the sick woman's mouth was black, and that she was in terrible agony.
