Five minutes' after the letter wa handed to the president, the nomination nomina-tion of Governor Hughes was on Its way to the senate That body had adjourned ad-journed for the day, however, whn the papers reached the capital and ,o the senate will Dot hear officially of the designation of Governor Hughe to succeed the late David J. Brewer until tomorrow. While It Is expected that Governor Hughes will be confirmed wilh little, or no delay, u fs understood hvre tb.-t he will remain as the chief executive ex-ecutive of New York until October nnd will not take the oath of his netv oflice until the fall term of thp supreme su-preme court opens, the second Monday Mon-day in that month. He has been anxious to secure the best man he could for the supreme court vacancy va-cancy and he feels that he has done , so. He was much elated over Governor Gov-ernor Hughes' acceptance and tonight said: "I am very much delighted to secure se-cure Governor Hughes for the bench. He is a man of wide ex-perknce and marked ability and It Is a mighty valuable thing to have on the great bench of the supreme court a man of nffclrs. Governor Hughes is 4S years of age. I think, and even If he shouid retire at 70, be. will have had 22 years of solid usefulness on the bench." The appointment of Governor Hughes was received In Washington v 1th the greatest satisfaction. The announcement, however, came as n surprise, despite the fact that It bad been generally understood the position posi-tion would be tendered him. President Ttift had been warned Governor Hughes might not he able to accept because his service as governor of New York had depleted his sanill private fortune and be felt the neces-rlly neces-rlly of again enterlug tho practice of law to earn a competence for himself r.ncl family. This did not deter the president, however, and he had optimistically opti-mistically awtlted a reply. The first overtures regarding the appointment ap-pointment are said to have- been conducted con-ducted through Senator Root. It was not until Friday that the president wrote a formal letter offering tho place to tho governor. The fact was carefully guarded Governor Hughes deliberated for a day and yesterday wrote his acceptance The letter reached the White House this afternoon after-noon as the president was preparing o leave. He delayed his departure long enough to see the nomination was sent to the senate and directed an official statement be prepared. It is believed the appointment will eliminate eli-minate him from the state campaign this fall. The campaign will be only fairly under way at the time the gov-ernor gov-ernor will take the oath of office and cn'er upon his judicial duties. The news of the appointment and acceptance of Governor Hughes reached the justices of the court just as they were adjoruning for the day. All were surprised and pleased. "V am delighted," Vild Chief Justice Jus-tice Fuller. , "A fine appointment," said Justice Harlan. v "I am delighted to hear It," declared declar-ed Justice White "Governor Hughes is a man ot high character and great ability," was Justice Jus-tice McKenna's comment.
