Show DAVID ECCLES GOES TO POBTLAfffl Portland, Ore., March II Names of all the persons ' accused and the charges in the indictment returned yesterday In sympathy with alleged land frauds in eastern Oregon by a grand jury In the.pnUed Slates district dis-trict court were m?.d? public today. The persons Indteufd are David Ic-cles Ic-cles of Ogden, Utah, president of tho Oregon Lumber company and the Sumptcr Valley Railroad company; Frank M. Shurtllff. Fred H. Atkinson and William Green, all thTce of Baker City, Grant Geddea, manager of the two companies; Joe Barton, assistant chief engineer of the railroad company com-pany and James Smurthwalte, former bookkeeper of tho lumber company. The indictment charges tho accused with having entered into a conspiracy conspir-acy to defraud the United States government gov-ernment of part of Its public lands located In the eastern part of Oregon during October. The indictments ciinrge that the alleged conspirators procured persons fo enter and file upon lumber land and after the entrant en-trant had recelvel his patent, they caused to be deeded to the companies the land described in the patent. The I indictment charge3 that the entrants were paid sums rasping from $50 (o $200 each - At the time the' present investigation investiga-tion was started. In February last. It waa believed that , the last alleged overt act within tho statute of limitations limita-tions was the alleged purchase of a claim Hied on by John Rafferty ot Sumpter, Ore. Tho statute of limitation: limita-tion: according to the federal authorities author-ities would have expired on the day the indictment was returned. Alleged purchasers of other clalmn subsequent to that of the Rafferty claim aro asserted as-serted to have been discovered by the grand jury and these alleged purchases pur-chases also it Is said, are made part of the Indictment. According to a report received here today. David L'ccles is now on hia way from Ogden to Portland to sur render himself to the United States otllcers.. Geddes, Barton and Smurthwalte Smurth-walte were arrestod yesterday and today gave bonds for their appearance appear-ance in the sum of $5,000 each. Shurtllff, Shurt-llff, Atkinson and Green are said to be in the custody of the United States officers. They have not as yet appeared ap-peared here. |
