I t ' r EDITORIAL THE REAL PROBLEM Reprinted from the Salt Lake Tele-gram of Wednesday, October 21, 1925. When Judge Galen S. Young of the city court denied a motion for a change of venue submitted by F. W. James attorney for a man charged with a violation of the liquor laws, he apparently made some more work for the Utah supreme court. Mr. James declared that it was manda-tory upon the judge to grant the motion and qerved notice that he would seek a writ of mandamus from the supreme court. In seeking a change to another court bias was charged by the defense attorney. He probably reached this conclusion through the announced determina-tion of Judge Young to sentence li-quor law offenders to serve five days in jail unless they could prove that they did not possess the liquor for purposes of sale or distribution. Whether or not this -- constitutes bias will probably be determined by the high court,' but meanwhile the real problem is ignored. As previous-ly pointed out by the Telegram, there are a half dozen or more city and justices' courts in ' Salt Lake county. Each is more or less a law unto it-- ; self when it comes to pronouncing sentence for ,one offense or another. One judge might hae a particular dislike for drunken automobile drivers and impose jail sentences, while an-other punishes the offense with a fine. The same situation exists in regard to liquor cases.. Judge Young .frankly says that- - liquor law violators who come before him will have to serve time in jail. The law provides for this prsiding judge and the different jus-tices exchange views and adopt uni-form policies for all of the lower courts in the country. and he is clearly within his powers, notwithstanding the fact that an-other judge might look upon the of-fense lightly and Impose a light fine. He might even suspend that. There is nouniformity in the lower courts. Each and every one is sub-ject to different reasoning. For this reason there is a wide variance in the sentence imposed. The strange part of it all is that all of them operate under the same laws. The same law prevail. in each of them. The laws are uniform but the penal-ties are not. So it is that the main problem will remain long after the supreme court has determined wheth-er Judge Young Is biased when he publicly announces heavier sentences for violators of the liquor laws.
