| Show AS ACT pertaining HIGHWAYS TO HIGHWAYS sec ce it ty the government and of the territory of utah tat 11 ll roads shall be considered conti dered aa public highways which ar now used as such and have been declared buck by order of the county courts or which may bo hereafter so declared by the county courts within their respective counties or by municipal corporation sec highway are roads or alleca and bridges laid out or erected by the public or if laid out or erected by others dedicated or abandoned to the ua of the public sec roads laid out and record ed aa highways by of the county court and all roads used as such for a period of five years are highways ligh ways whenever any corpora ion owning a toll bridge or a turn like plank or wagon road s dissolved or discontinued or has expired by imitation the bridge or road becomes highway sec A road not worked or used or the period of five years ceases to be a highway for any purpose whatever sec the clerk of the county court must kep a book in which must be recorded all proceedings of he court relative to each road district including orders for laying out altering and opening roads and of each road district its supervisors ita roads high ways con facts and all other matters pertain ng thereto sec by taking or accepting land or a highway the public acquire only the right of way and incidents to enjoying and maintain ng it A sidewalk on he highway alone the line of his and subject however to the au conferred by law on the court and the supervisors of highways and any person using such sidewalk with horse or team without of the owner is liable to nuch owner or occupant for all damage buttered ered thereby sec any owner or occupant of and adjoining a highway not less than four rods wide may plant trees on of such highway contiguous to bis land they must be set distance of at least fifteen feet each other in regular and not more than ten from he boundary of the lithway ligh way if the highway is six rods ride or more the row must not be ess than ten nor more than twelve beet from the boundary of the highway whoever injures any of said reea is liable to the owner for the damage which is thereby sustained sec every gas water telegraph or railroad corporation has the right of way through the public ways and squares in any city village or town with the consent of the authorities thereof and under such reasonable regulations as said authorities and law prescribe the county courts of he several counties have power to grant a right of way ivr ha public highways for railroads canals water pipes and regulations ave power first to divide where not already done the county into a suitable and convenient number of road districts and appoint supervisors or whenever vacancies occur and to report them at pleasure second TO cause to be surveyed viewed laid out recorded opened and worked suph highways as are necessary for public convenience third to cause to be recorded as highways such roads as have become such by or abandonment to the public fourth tn abolish or abandon such as are unnecessary fifth tp contract agree for purchase or otherwise acquire tb of way over property for the use of public highways and for that purpose institute r require the county prosecuting attorney to in proceedings for the acquirement of said right of way as provided in title XI chapter I of be compiled laws of appropriated and expend ed on the principal roads and e under the direction of the county court sec 10 tho county court shall furnish each road supervisor with a blank receipt book with stubs on which shall be stated by the supervisor whether said poll tax was gaii in cash or labor and the receipt be given to the party as evidence tha he ha paid bis poll tax and salt book and stubs be returned to the county court with his andua report together with the treasurer s receipts sec 17 every supervisor must make to the county court annually on or before the first monday n december of each year a written te port containing first the names of all persons aises ged tp work in his district Second The names of al who have actually worked and the number of days third the names of all who have commuted and the amount received from them fourth the names of all delinquents and the amount due fifth the amount of labor expended at each point and the kind of labor performed sixth an accurate account of every day he himself was employed and the nature and items of the service rendered the county courts may require special reports rom road supervisors when deemed proper sec 18 A failure to make a re ort as required or to pay over on he order of the county court any moneys in his hands subjects the supervisor to a penalty of twenty five dollars 25 to be recovered in tn kation on bis bond together with any alance due from him suit may be instituted by the county attorney under order of the county court sec 16 whoever wilfully or care essly obstructs or injures any highway by flow of water or otherwise is bable to a penalty of five dollars for each day such obstruction or injury remains any person or ler water under their con rol to flood any highway to the in ury thereof shall be liable to the sity or county as the case may be or the damage and to a fine in any bum not exceeding twenty five dollars 35 sec 20 whoever removes or injures any milestone or guide post or any inscription on such erected on any highway is liable to a of ten dollars 10 for every such of fence sec 21 any person or persons who drive loose herds of borses cattle sheep goats or swine over the highways where they pass on dug ways shall be liable for all damage done to such highways by caving of the banks or rolling loose rocks into the same sec 22 the road supervisors may put up on bridges under their charge notices that there is five dollars fine for riding or driving on this bridge faster than a walk abos ever thereafter rides or drives faster than a walk on ouch bridge is liable to a penalty of five dollars for each of fence sec 25 whoever digs up cuts down or otherwise injures or wilfully destroys any shade or ornamental tree planted and standing on any highway is liable to a fine of dollars 25 for each such tree sec 24 all penalties or forfeitures under this act and not otherwise provided for must be recovered by the road supervisors of the respective districts and be applied on the highways in which they are col lecter sec 25 all acts or parts of acts in conflict with the provisions of this act are hereby repealed approved february p 1880 |
