Show oo Contends Sale of Cloth Not Included Under Anti-Prof- iteering Act . j i NEW YORK, June 3. A motion to! quash the federal indictments return-led return-led last week against the American' I Woolen company of New York, the, American Woolen company of Massa-1 Ichusetts, and William M. Wood, pros-' lident of both companies, charging, them with profiteering in sales of wool 'cloth, was argued before Judge Jul-1 lan W. Mack in United States district court here. No decision was rendered, Judgo Mack directing Charles Evan3 Hughc3 for the defendants, .and Herbert C. Smythc, special .counsel for the government, gov-ernment, to submit briefs not later than next Tuesday. Mr. Hughes, in arguing for the motion, mo-tion, contended the indictment which contained 14 counts alleging 14 specific speci-fic sales of cloth at "unjust and unreasonable" un-reasonable" prices, did not charge any crime. He maintained that cloth or pieces of cloth alone aro not wearing apparel and that sales of cloth do not constitute sales of wearing apparel under the Lever act. J |
