Butler, as administrator for the estate of Omiond II. Butler, against the Oregon Ore-gon Short Line railroad. for the death of Mr. Butler at the Twelfth street crossing of the railroad tracks, when his machine was hit by a train, March 19, 1910. The case is scheduled sched-uled to open tills week before Judge A. E. Pratt. In the complaint, the plaintiff alleges al-leges that the train was proceeding at an excessive rale of speed and no warning was given at the crossing, before the accident.
