HOUSE TAKES UP PROHIBITION ACT WASHINGTON, June 26 The house judiciary committee voted today to split prohibition legislation into three parts, with enforcement of war time prohibition separate and distinct from the others, which relate to constitutional constitu-tional prohibition and the manufacture of industrial alcohol. For the first section the committee decided to submit in whole its wartime war-time enforcement bill Introduced at the last session of congress and on which no action was taken. This defines intoxicants as beverages bever-ages containing more than one half of one per cent alcohol. It contains no provision, however, which would make it unlawful for a person to ' possess" pos-sess" liquor. Members explained that by adopting this plan there would be no confusion confus-ion later if the president should issue a proclamation declaring demobilization demobiliza-tion completed, which would end wartime war-time prohibition. NEW YORK. June 26 Tho opinion in the brewers injunction case written by Judge Henry G. Ward and in part concurred in by Judges Henry W. Rogers and Charles M. Hough, ordered order-ed stricken out of the lower court's ruling the injunction pendente lite against the tcderal prosecutor. Maintaining that the suit instituted by the Jacob Hoffman brewing company com-pany and others, upon which the injunction in-junction was based, is against the United Uni-ted States, that there is no direct injury in-jury to the complainant's property rights, and that the act of congress under which the brewers charge Mr. i Caffey threatens to proceed, is con- stitutional, Judge Ward expressed the I opinion that the federal attorney "w ill j not transcend this authority." t i '
