W Agee has just handed down a very important decision pertaining per-taining to. the purchase and sale of land, in deciding the case of Alexander Rlrie vs. Clarence W. Brooks and Mary Brooks, which wr.s tried in the district court last week. The plaintiff, Mr. Ririe. was desir-our desir-our of buying aTarm and last Januarv while the snow was on the ground was shown the farm of defendants at harr West, and representations were made to him that the iaufi was first class No. 1 soil and free from alkali and minerals, and that there was a water right with it with an abundant supply of water. Mr. Ririe relied upon said representations and purchased the land for $12,-000. and paid $2,000 down in cash, traded his ciiv propc-rtv valued at $6000. and agreed ' to p;( v $4u00 more In yearly payments, and moved upon the premises about the middle of March. The snow remained on the gTound until the latter part of March so that Mr. Rlrie could not ax-amine ax-amine the soil, but when the snow melted off he ascertained that the laud was not first class No. 1 soil and that practically all of it was mineralized and full of alkali, and there was not sufficient water to irrigate one-fifth of the land, whereupon he promptly notified defendants Brooks, and demanded de-manded cancellation of the trade and a return of his property and money, which the Brooks refused to do, whereupon where-upon Ririe, through his auorneys, Choz & Stine, instituted action in the district court for restitution, which was heard last week. The case attracted more than ordinary ordi-nary attention and many witnesses were called to prove the character of the land involved and representations made, and Judge Agee in a written opinion, filed this morning, rendered his decision, finding in favor of plaintiff plain-tiff Alexander Ririe, and against the defendants Brooks, requiring the defendants de-fendants to repav to Ririe the J2f00 cash received and reconvey to him the property received in trade. 00 |
