Farrell of Payette, formerly of Denver, Colo . arrested In this state and bound over to the district court of Canyon eoun to stand trial on the charge of bigamy, and Mrs Certrude FarrHI No. 1 of Fort Lucon, Colo., held as a material witness against her husband, have been ordered released from cus lody by the supreme court of this state, having appealed to that tribu nal for a writ of habeas corpus to lib erafe them, which was pranted The court held that Mrs Farrell So. 1 could xen-ise the exemption right under un-der the statutes of this state not to testify against hr husband, and the authorities therefore were not justi fled in holding her under bond as a witness in th district court She left Idaho immediately for her Colorado home. Farrell Far-rell appeared at the home of Mrs. Farrell No. 2 Mrs. Farrell No 1 had. however, rend th1 account of her husband's hus-band's death and she hurried from Colorado to Idaho She arrived at Payette, where she made herself known Knowing that Farrell had married mar-ried there recently, the authorities became suspicious and arrested hini on the charge of bigamy. Shortly after her husband s arrest. Mrs Farrell No 1 started back to her Colorado home. She knew of her husband's second marriage Wishing to hold her as a material witness, although al-though she refused to testify agains' the man who deserted her and married mar-ried again before they were legally separated, the officers removed Mrs Farrell No 1 from an eostbound train, took her before a Justice and bad her bound over to appear in the district court under a $500 bond. Acting concurrently con-currently with her hUSband, Mrs Farrell Far-rell No 1 appealed to the supreme court for a write of habeas corpus to oi ur t heir release. She Is on friendly terms with Mrs. Farrell No 1 and Is the daughter of a prominent land highly respected rancher in the Payette valley. She. too, refused and still refuses to testlfj against Farrell |
