witness aad a laugh new york jan 16 many witnesses new botho case testified at the trial of harry K thaw today and told stories of his eccentricities during the years preceding the killing of stanford white they all declared he impressed them as being irrational the most interesting was that of christopher baggan a steward of the new york whist club who told of thaws actions the day of the tragedy and who under cross examination by district attorney jerome gave amusing details of whist games in which thaw and several mon of prominence participated new york jan 15 the skeletons of ancestry the basis for ahe defense of insanity in the trial of harry K thaw for the killing or stanford white will continue to be exhibited ln court today ly the attorneys for the defense are laying bare that history of the thaw family on both the fathers and mothers side which was only hinted nt in the former trial then the defense was a brain storm now it is hereditary insanity an insanity which the defense has stated began long before harry thaw was born and which up to th e present at least they have riol attempted to put an end to whether later they will claim that thaw is pow sane is a matter wholly for speculation A man whose school classes harry thaw attended when he was a boy aej a woman who nursed him when he was in monte carlo years ago have already been called to ane witness stand and have told of the actions which they believed snowed thaw mentally unsound the dei enss has promised to put forward several other witnesses to testify io his mon dial condition long before tho night ot the tragedy on the madison square garden roof and it Is probable that some of those witnesses will be called today mr littleton Is beginning at the very earliest period of thaws life possible horatius Horat lus W wood of philadelphia was called to the stand as the first witness today dr wood acme years ago made an ex of harriet alice thaw a relative of the defendant district attorney jerome objected to the physicians testimony but was overruled by the court as the relations between and patient did not exist ln this instance dr wood said that miss thaw was of mind the next witness to be heard told of new eccentricities just before the killing of stanford while he was christopher baggan a steward of the new york whist club thaw was in the club on june 20 1906 just five days before the roof garden tragedy although the day was hot thaw insisted on taking a screen with him wherever he went about the rooms ho was nervous excitable and ir retable rl table and once as he whereabouts of john ross a paternal cousin of the defendant but district attorney jorome objected on the grounds that the doctor obtained his information while acting in a professional capacity and it would require a waiver from his client before he could testify justice dowlong sustained the objection over the protest of mr lettleton on cross examination district attorney jerome drew out the fact thai henry copley while incapacitated for mental work was never confined in an asylum dr wm W S butler of roanoke va former president physician at the western lunatic asylum ata un lon va where horace thaw a paternal cousin of harry K thaw was confined was the next witness when he was asked as to horace thaws condition up to the time of his death jerome again objected and was sustained the district attorney also successfully cess fully objected to the introduction of evidence of the commitment papers prepared when horace thaw was admitted to the asylum on grounds that it was hearsay mr lettleton took an exception to the ruling dr L S foster of norfolk va or merly of the eastern state hospital for the insane at va where wm S thaw another cousin of the defendant was confined next was called to the stand dr foster waa identify the records of the asylum as to the d of wm S and did so when the record was offered in evidence mr jerome objected on the ground that it was incompetent testimony and waa sustained mr lettleton hero recalled mr deemar and succeeded in circumventing the former objections of the district attorney as to the case of john ross dr deemar sax ne ceased to be ross physician after the latter had been committed to the hope institution ution of feeble minded he was allowed to tell of ross mental condition and declared it was unsound charles koehler of winona glnn who was a teacher at wooster university ver sity wooster Wo ostor ohio in when harry thaw waa a student there took the stand and was asked to tell his impressions of thaw as a boy sixteen or seventeen years of age jerome objected but the witness was allowed to proceed harry thaw always had a nervous gait and walked jerkily he said his eyes were striking afe complexion anaemic his manner in the class room was abstracted and indifferent his eyes usually had a fixed staring gaze there was never any warmth in his eyes no illumination mr kochler said ho abet doah of thaws eccentricities in a in 1897 followed dr chase on the stand mrs gonotte is an english woman by birth but now is a resident of california district attorney jerome objected to any testimony from mrs gonotte unless thaw in open court waived the point of privileged consultation as between pauleni and nurse which Is the same as with a physician justice dowlong asked he witness if he desired to enter a waiver 1 I do said
