Show STATE HOUSE WAR state auditor of idaho applies for writ of prohibition baiso ida jan 15 another chapter was added to the row among the state house officials today when state auditor bragaw filed an application in the supreme court tor a writ of prohibition against governor goodmo secretary of state lansdon and actor ney general cuhen asking that they be prohibited from interfering with the business laffaira of his office and that an order be issued compelling the trio as members of the board of examiners to pay the salaries of the clerks in his office this suit Is the outcome of the refusal of the board 10 pay a salary of per month for the services of mrs bragaw and in cutting down the salary of robert brar gaw jr from per month to 75 the suit was filed byc H libby attorney for bragaw who sets out the fact that the legislature appropriated tor maintenance of the auditors office and of that amount was to be used for clerk hire it shows that mrs bragaw was employed aa clerk at per month and robert S bragaw jr at and that the aal aries were just and reasonable and that their employment is necessary to properly conduct alie business of the office and that the salaries do not exceed the amount allowed by the appropriation pria tion the complaint further states how properly prepared claims of said clerks for services were presented to the board after being duly approved by himself and that said board of examiners have refused and still refuse to allow the claims with the exception of 75 per month to robert S bragaw jr which is entirely inadequate tor hla services as clerk and that the action by the board in refusing to allow the claims is done contrary to the law of the state and is a flagrant usurpation of authority and the complainant believes that said action taken by the board emanates from personal selfish pernicious and malicious motives on the part of the members of said board the plaintiff alleges he Is without any other adequate remedy and therefore makes this affidavit asking the court to issue a writ of prohibition as to goodings Goo dingi lansdon and cuhen to restrain them from further interference with his business and conduct of his office and commanding them to allow the claims of the clerks as presented by him as detate auditor |
