Show PATENTS AND BILL measure Is 1 of great interest to arner american manufacturers 11 april IS patents and designs bill which today unanimously passed its second reading in the house of commons is of particular interest to io american manufacturers of ot machinery largely used in british factories who having secured patent rights in grat great britain continue to supply british factories with nia machines chines made in america the measure is designed to compel these manufacturers manufacture ra to make malte in great britain the machines which they sell or lease here the bill eventually will become law bul but whether it will be effective in enforcing its subject is questioned in some quarters clause 10 enacts that at any time not less than three years after tho the grant of 0 a patent any person interest ei ej may apply for the revocation of the patent on the ground that the patent article is manufactured exclusively or mainly outside the united kingdom tho controller may revoke the patent unless the patentee proves that the patented article Is manufactured to an adequate extent in the kingdom or gives satisfactory reasons why the article ig Is so sd manufactured the shoe and leather record the official organ of the shoe trade believes this clause ts is aimed at shoe machinery invented and manufactured in america and patented but not made in great britain the same paper criticises criticizes clause 16 which it says was avowedly inserted for the protection of the british shoe manufacturer against the so called american shoe machinery trust this clause provides that it shall be unlawful in any contract made after the commencement of this act for the sale or lease or license of any patent article r ae to impose as a condition of such sale leasing or license to use a condition the effect ot of which will be to of licensee from employing in prohibit or restrict the purchaser his trade or industry any article or class clau of articles acquired from any person other than the person by whom tho con condition is imposed or his nomis ino einab and any such condition inserted in any such contract shall ishall bo be null and void the american manufacturers have many machines on lease in england which would be affected by this clause should it become law |
