JOHNSON discharged he made an attack on a colored man when the case of the state of utah is frank johnson who was charged with assault with a deadly weapon was called in the district court this morning district adorney halverson arose and moved that the defendant be discharged stating diat he did not believe that there was sufficient evidence to convict the man on the charge A number of the witnesses who testified at the preliminary hearing have left the city since that time and evidence available was not considered strong enough by mr halverson to make a case against the accused johnson was alleged to have made an assault with a deadly weapon on albert J taylor a colored man on the night oe august 17 cutting him in the neck the fracas occurred in a grant avenue aloon and was alleged to have grown out of a remark by johnson re gardine colored drinking in the same place witha white man tay lor is said to have taken exceptions lo 10 the remarks and made A pass at johnson and in the alx up which followed taylor was cut in the neck
