works company in a lengthy communication sent to the city council and presented to that body at its regular session last evening the franchise passed recently by the council and approved by the mayor was re jetted by the water works people however steps were immediately taken by the council to bring about a meeting between the representatives of he company and the members of the council in the hope ot framing a franchise that would be acceptable to both as well as to the citizens of ogden the letter through which the franchise was rejected read as follows 1 I am directed so return herewith acceptance an ordinance passed by bour honorable body on i august oth and approved september i entitled an ordinance braht ng to the ogden water works company its successors and assigns etc c for the reason that in its present orm this ordinance would have the effect of forcing the water company into bankruptcy and making valueless is outstanding bonds while this company has always been anxious to extend to th public and lo 10 ogden city every privilege and concession possible yet in justice to he people who in good faith relying upon tho crople of this city and their representatives to use equity and jus fee invested their money in this en we foel that we would have 0 legal or moral right even in the uise of a franchise to accept condi ions which would result in making heir investments valueless As the ordinance now stands it would bo impossible for this company or any other company to furnish water without serious financial loss besides the tenor of the ordinance while ostensibly granted for fifty years ts really limited to the actual pleasure of the city councils which may mean but a very short time and further this ordinance without giving corresponding benefits to the water company will extend its already exacting water privileges by forcing this company to furnish free water for private sidewalk sprinkling in tho entire city and free water cpr alre plugs in private houses beside reducing the public hydrant centala over seventy par cent per annum and under certain conditions materially increasing the free public user ot water aven these rates have a stability ot only tin 5 cars and arc during all times subject to so many restrictions that no company would at any time be able to its exact status besides this our company is asked to cancel as indebtedness of nearly which tle city owes and thereafter in addition to an annual tax of about we are required to pay to the city 2500 per annum which amount Is gradually increased I 1 afi the city grows it at any time the city council shall feel inclined to grant a reasonable ordinance we shall feel it our duty to operate cooperate co with your honorable body in making any reasonable changes beneficial to ogden city or s inhabitants which will not be disastrous to th creditors of this company but meanwhile we shall continue under contracts which ave been repeatedly declared legal bv the highest courts of utah as well as by the courts of the united states very respectfully C 11 manager mr williams moved the filing of the euer and then entered a motion to the effect that the recorder ask the local officers of company to meet with the council at some early date as the water works people had said ihly would be glad to do in a communication mayor glasmann 6 a ted that ho would have to go to new tork on important business during the middle of the week and asked bat a mayor pro tern be appointed io serve during his bosence ao sence on molon ot mr davedson Dav ldson mr randall was named as mayor pro tern with these two matters out of the way the greater portion of session vw taken up in the discussion ot magaera pertaining to tho construction of side walks about the city to start off with there was a committee composed of J j jones frank wiant T S tracy aud prank kic r from the second ward present who were given the floor to enter their protests against the raising of the side grade on lincoln avenue between twenty first anu twenty sec ond streets mr jones acted as spokesman for the party and stated abc length their reasons for objecting to the grade established and said that the property along that block would damaged be to the extent of it the grade were raised the city engineer and several of the councilmen took part in the discussion after which on motion 0 mr williams the city engineer was instructed ted to notify the contractors doing the work along the said block to discontinue work until a new survey might be made and it could be ascertained whether or not a lower grade could be made the mayor took the floor and elated that the business men along the east side of washington avenue be tween twenty fourth and twenty nath streets threatened to bring suit against the city on account of the water that stands in front ot their properties tha mayor stated that this nuisance should be overcome before the snow water commenced to run in connection with this question the city engineer stated that the only vay that the trouble could bo remedied was to reshape the gutter anich he claimed would not add very much to the beauty of the street but would remedy the evil mr nye then moved that tho draft plans in ao corrance cor dance with his statement and submit the same to the council at its next regular meeting the motion prevailed the mayor again the bod in connection with repairs to side walks pat in by tho city and those put in by property owners stating that there was a city ordnance which stated that tab former would be repaired by while those put in by private owners would have to bo repaired by them air nye claimed that there was a state law covering the point and which mady iliin that the city madelsa repairs just the same in in the aum of were also allowed fire chief graves sent a communication to the council in which he stated that lie had visited the grand opera house and found that nothing had as yet been done toward installing fire protection that ho called upon sir cort manager of the northwestern theatrical association who controls the house and that mr cort said he was about to place a tour inch main to the theater and to this a standard hose will be attached the matter was laid on the table tor one week the report of the sanitary inspector proved the allegation that diphtheria was rapidly spreading it being reported that there are now thirty basea of that disease in quarantine the computation of the protests against the building of sidewalks on lincoln avenue between twenty first and twenty fifth streets madison avenue between twenty third and awen ty fourth streets and between twenty fifth and twenty seventh streets showed that the city had gained jurisdiction by a small margin on lincoln avenue that the project had been defeated on madison avenue between twenty third and twenty fourth streets by 78 per cent protesting and that tho city had gained jurisdiction on the same street between twenty fifth and twenty seventh streets it was thought that when a new grada had been established on lincoln avenue in accordance with tho petition of the committee who were pres ent from that district a number of protests would be recalled and that a more comfortable margin would be had for tho doing of this work tills matter yas then laid over for one i week As ahe city had gained jurls diction on the two blocks on madison avenue the engineer was directed to draft the necessary ordinance mr chambers stated that the sidewalk contractor was about up with the worl that he had been instructed to do and got a motion through instructing ting the city engineer to notify the contractor to proceed with the sidewalk wherein the city has gained jurisdiction on motion of sir nye the city engineer was instructed to have the intersections ter to the sidewalks on awen ty third street put in after this was disposed of mr paine introduced a motion to have the sidewalk work done on grant avenue between twenty fifth and twenty sixth streets on the east side mr spaine took the stand that the city forced the property owners on the opposite of the street to put down a walk and that it had done its part toward placing a walk along the city property mr nye opposed the starting at this work and when the vota was taken the motion won out 6 ayes to 3 nays A petition was read from the residents of the first ward askins that steps be taken to establish a sewer system in that ward that the boundaries of the same be made so as to make tho same a reality on motion oe mr davidson the petition was accepted and referred to the law committee and the city engineer street supervisor L B balch was anted 15 per month for the past 0 o years as extra remuneration for work done on sundays and holidays on motion of mr handall 20 was appropriated to make repairs to tho roof of the fire station and the chief of police was instructed to have an iron railing placed along the steps leading into ane police station on the west side sir williams brought up the matter of opening twentieth street he recited at length the steps that had been taken the past two years in tho matter the street committee was instructed to maka arrangements to have a temporary crossing put in 60 that teams could cross the tracks and permit of the closing of spencer street after which tho railroad people are to be notified that tho city has done its part and they would bo expected to do theirs an adjournment was then taken until wednesday night CANAL MATTERS DISCUSSED at luncheon ot engineers with
