Show MAY QUASH CHARGES Legality of Denver Indictments In-dictments Questioned; Court to Decide Denver, Sept. 12 Whether approximately approx-imately 50 grand Jury indictments, returned re-turned Tuesday against city officiate owners of property and residents of Denver's segregated district, will 1x3 sustained or nullified rests with Judgo J. H. Teller of the criminal courL The legality of these Indictments hinges on tho court's decision on a plea in abatement and a motion to quash Judge Tellor will hear arguments an.l return a decision next week The plea in abatement sets forth that District Attorney Willis V. Elliott Elli-ott was not properly set aside as adviser ad-viser to tho grand jury, that the appointment ap-pointment of J. H. Chiles as special adviser was not legal and that, therefore, there-fore, the 'indictments are not legal. The motion to quash cites a provision of the city charter, which it is claimed claim-ed gives the fire and police board executive ex-ecutive control of the redllght district and removes such regulation from the jurisdiction of the court. Counsel agree that If these points are sustained it will result in the release re-lease of Mayor Henri J Arnold, former for-mer Mai or Robert W Speor and other city officials against who mindict-ments mindict-ments were returned. |
