Show II MURDERERS FAIL IN TKEIRPETITION I Unless favorable action be taken by I ihe state board of pardons, the laBt I hope of Harry Thorno and Thomas J Riley, convicted murderers of George k FaBsell, an East Fourth South street j grocer, of escaping the executioner J has gone. The state supreme court yesterday ; donled the petition of Thome for a ' ' rehearing of hlB second appeal to the i tribunal from the judgment of the low-! low-! er court. The remittitur to tho district dis-trict court was sent down yesterday In the Thorne case and the same action ac-tion will be taken today in the Riley case, after which both men will be resentenced in the district court. Tho crime for which both were con- vlcted, Thorne after having had two f trials, occurred early in the evening of March 24, 1910. Masked as highly high-ly waymen, the men entered the grocery store of George Fassoll, in Salt Lake, and in the hold -tin Fassell was shot and killed. t Both boys have previously elected f execution, by shooting, and it Is not expected that either will change In fs i tho manner of death to be selected vf ' when brought In for final sentence.
