Show OWNER OF THE EXAMINER FILED ON CITY WATER. The Examiner, of which M. S. Browning is the principal stockholder, stock-holder, thinks it is a bad thing for William Glasmann to file on the South Fork water for irrigation purposes, simply because the city has the first filing for water rights. The law provides, of course, that a man can file on the water but takes his rights second, third or fourth, as the case may be according to tho number that have filed on the water ahead of him. Now everybody knows that Mr. Glasmann has tried to bring the farmers and the city together for several years. lie succeeded loo, but at the change of city government gov-ernment the city withdrew from the compact. Then Mr. Glasmann was no longer mayor. He had been out of office almost a quarter of a year. lie decided that the clam should be built regardless of the action of the city. He found that the city filings did not cover ir- , rigation of farms. He filed on the water for frngation purposes. He bought lands to build his dam on He contracted to build the dam. For six months he and a force of men were kept busy preparing plans. Then comes the city and says: "Stop, avc want to build the dam," and offers to buy the land Avithout any offer to reimburse Mr. Glasmann for the thousands of dollars he has spent on the enterprise. en-terprise. And all that, the Examiner says, is bad dreadfully bad. Why, it is a crime! Let us sec. M. S. Browning, the principal owner own-er of the Examiner, filed on city water not long ago Was that a crime? Mayor Conroy, five years ago, bought from Frank Moore the water right on Willard Creek for $5,000. M. S. Browning filed on the water of that creek and, as a second filing. Because the city failed to protect lLs right, Mr Browning gained the first right and complete ownership. Only a few days ago tho city was sued to pay , the $5,000. The city at first claimed that the right was valueless, but when it was shown that the right was good when the city bought, the city promptly compromised and paid $3,500 to settle the bill. Now, if it is a crime for the publisher of the Standard to file oiJ water with rights secondary to those of the city, then it is also a orinic for one of the publishers of the Examiner to file on top of! the city's rights What is sauce for the goose is sauce for the gander, gan-der, so now, Mr Examiner, first put the stripes on your own people |
