Show vu- FRUIT COMPANY IS MADE A DEFENDANT Salt Lake, Feb. 27. Suit was filed In the federal court yesterday afternoon after-noon by Walter T Holt of Oakley, Idaho, through his attorney, D. O. Wil-ley, Wil-ley, Jr., against J. M. Jensen and A. G. Barber, former state sonator of Lo-,gan: Lo-,gan: George Spencer of Randolph, W. A. Miles and J. A. Hancock of Hancock Han-cock Bros. Fruit company, this city. The defendants named composed the original board of directors of tho Tampico Fruit company, from whom tho plaintiff seekB to recover $5,000, which he alleges the defendants obtained ob-tained from him by fraud. In his complaint tho plaintiff alleges among other things that the defendants defend-ants represented to him that the land owned by the company in tho state of Taraplco, Mexico, was of rich, alluvial, deep soil, free from minerals and especially es-pecially adapted to the cultivation of bananas This land. It is alleged, has been proven absolutely worthless for the cultivation of frulL The soil, It Is said, Is Impregnated with salt, and the climate, cli-mate, ropreBented as perfect for banana ba-nana growing, Is said to be too torrid for that purpose. This condition is said to have been proven by experiment experi-ment It also is alleged in the complaint that the company false represented to tho plaintiff that W. S McCornlck, J. E. Cosgriff and other prominent men of this city were interested in the company's project |
