Harold Frank Honwood. slayer of George E Cope-land Cope-land of Victor, Colo , a well Hncyn mining man who was shot acddentallj by Henwood when the latter fired upon and killed Sylvester L. Von Phul. the balloonist of St. Louis, was todnj found guilty of murder In .th ; second degree. Tho penalty is from 10 years to life in the penitentiary. District Judge Greoly Whitford however, granted a 10 days' stay of execution to permit the defendants counsel, John T. Bottom, opportunlt to file a motion for a new trial Hen-wood Hen-wood maintained his calm demeanor when the verdict was announced. Henwood Is Disappointed. "I am disappointed, of course,' he said to a group of newspaper mon, "but I am sure that If a second trial is granted me I will ultimately gain my freedom." . .. On May 24, in the barroom oi uie Brown Palace hotol, Sylvester L. Von Phul knocked down Henwood and the latter, as he arose from the floor, drew a revolver and fired five shots at Von Phul. Three of them struck their mark, and the other two .went wild. One hit Georgo E. Copeland and the other struck John Atkinson of Colorado Col-orado Springs. Von Phul and Cope-land Cope-land died, but Atkinson recovered. Tried for Copeland's Murder. Tho state elected to try Henwood for killing Copeland. The complaint charged wilful, deliberate murder and the plea of Henwood was self-defense, based on previous quarrels between Von Phul and himself. When arrested Henwood told the chief of police that the trouble was over chorus girls. It developed, however, how-ever, that Henwood had been trying to compel Von Phul to return letters written to Von Phul by 'Mrs. John W. Springer, a society matron and wife of a prominent Denver banker. Mrs Springer was a witness in the case, and her presence In the court room in that capacity added much to public Interest. The prosecution put witnesses on the stand to show alleged al-leged relations between Mrs. Springer and Henwood, and its contention that Henwood was jealous of Von Phul and, fearing that he was about to be sup-nlanted sup-nlanted In Mrs. Springer's affections, resolved to kill Von Phul. May Appeal Case. Since the Bhootlng of Von Phul and Copeland, Mrs. Springer has been, sued for divorce and the hearing has been set for next Monday Attorney Bottom Bot-tom made many exceptions during the trial, particularly as to tho rulings of the court. He said today that the case would be carried to the supreme court, if necessary After the verdict had been announced, an-nounced, Attorney Bottom asked leave to question "Juryman No". 1." This was granted. Mr Bottom then questioned as to his "correct" name He had been accepted undor the name of Joseph Jo-seph Duval. Mr. Bottom asked him If his real name was not Taliaferro. He admitted that that was one of his given names |
